【摘要】 邓小平人权理论是邓小平理论体系的重要组成部分,它是在特定的历史背景、时代背景和现实背景条件下,吸收了古今中外人类人权文化的优秀成果而产生的。它科学地透视了当代人权理论的精华,包括了许多富有创造性的,又适合我国具体国情的新见解、新观点、新思路,勾画了中国特色社会主义人权理论的丰富内涵,体现了鲜明的政治立场、时代特色和实践精神,必将对我国人权事业产生积极影响。学习邓小平人权理论,科学总结邓小平人权理论的启示,对于我们坚持中国特色社会主义人权观,正确观察和处理国际人权论争问题,不断取得国际人权斗争的新胜利具有重大的理论意义和现实意义。全文主要由三部分构成:第一部分,邓小平人权理论的形成背景和理论来源。这部分首先对人权的概念进行了界定;然后对邓小平人权理论形成的历史背景、时代背景和现实背景进行了分析;最后从马克思主义人权理论、毛泽东人权思想、中华民族的传统人权思想、世界人权理论发展的成果四个方面对邓小平人权理论的理论来源进行了论述。第二部分,邓小平人权理论的主要内容和特征。这部分首先从两种人权观的本质区别论、国家主权至上论、发展权利优先论、人权基本要求论等七个方面对邓小平人权理论的主要内容进行了较为详细地论述;其次详细阐明了邓小平人权理论的六个特征,即科学性、求实性、人民性、辩证性、开放性、和谐性。第三部分,学习邓小平人权理论的启示。这部分从六个方面归纳总结了学习邓小平人权理论的启示:第一,研究邓小平人权理论必须坚持马克思主义的立场、观点和方法;第二,对待人权问题必须变被动应付的策略为积极主动的策略;第三,研究邓小平人权理论必须注重实事求是、具体问题具体分析的原则;第四,必须加强国人的人权思想教育,使之树立科学的人权观;第五,必须加强人权理论创新体系的构建和人权研究队伍的建设;第六,必须紧密结合我国的具体国情构建比较健全的人权保障机制。更多还原

【Abstract】 The theory of Deng Xiaoping’s human rights, an important component of DengXiaoping’s theoretical system, was created in specific historical background, era background andunder the realistic background, absorbing the outstanding achievement of human rights at all timesand in all lands. It includes new and more creative opinions, views, thinking, which are suitablefor the concrete national conditions of our country; has delineated the abundant intension of thehuman rights theory of the socialism with Chinese characteristics, has perspected thequintessence of the contemporary human rights theory scientifically, the characteristic andpractice spirit that have reflected distinct political standpoint, era, will exert a positive influenceon the cause of human rights of our country. Meanwhile, studying the theory of Deng Xiaoping’shuman rights, summarizing the enlightenment of the theory of Deng Xiaoping’s human rightsscientifically have great theory meaning and realistic meaning to the thing that we adhere to theview of human rights of the socialism with Chinese characteristics, observe and deal with thecontroversy problem of international human rights correctly, the new victory of makinginternational human rights and struggling constantly. This thesis consists of three parts:The first part is the forming background of the theory of Deng Xiaoping’s human rights and itstheory source. This part defines the concept of the human rights at first; Then analyzes the historicalbackground, era background, and realistic background which the theory of Deng Xiaoping human rights wasformed; finally probes into its theory source from the theory development achievement of four aspects: thehuman rights theory of Marxism, Mao Zedong’s human rights thought, Chinese traditional thought ofhuman rights and the theory development of world human rights.The second part is main content and characteristic of the theory of Deng Xiaoping’shuman rights. This part at first analyzes the main contents of the theory of Deng Xiaoping’shuman rights in full detail from the essential distinction theory of two kinds of views ofhuman rights, the highest theory of state sovereignty, the priority theory of the human rightsdevelopment, the basic demand theory of the human rights,etc. seven aspects. Secondly hasexpounded six characteristics of the theory of Deng Xiaoping’s human rights in detail: thescientific, realistic, people’s, dialectical, opening, harmony characteristics.The third part is the enlightenment of the theory Deng Xiaoping’s human rights. This part hassummarized the enlightenment to study the theory Deng Xiaoping’s human rights from six respects:First, at any moment of Deng Xiaoping’s human rights theoretical research Marxist position, view,method must be adhered to; Second, the tactics which dealt with human rights passively must bechanged, our human rights theory research work must be regard as active and positive actions;Third, Deng Xiaoping’s human rights theoretical research must pay attention to the principles ofseeking truth from facts, the concrete problem concrete analysis; Fourth, compatriots’ human rightsideological education must be strengthened, the correct view of human rights must be established;The fifth, the construction theory of human rights’ innovation system and the construction of thestudy team of the theory of the human rights must be strengthened; The sixth, combining withthe concrete national conditions of our country sounder security mechanism and system of humanrights must be constructed.更多还原
