【摘要】 近年来,随着我国水资源短缺与社会经济发展的矛盾日益尖锐,社会各界包括法学界对节约用水重要性的认识逐步提高。本文试图从法律制度的建立与完善的角度,探讨节约用水的新途径、新办法。本文首先从节水制度的研究状况入手,在节水制度的研究成果、理论研究的薄弱环节、研究的发展趋势等三个方面,对节水制度研究现状进行了概述,为论文研究提供了宏观理论背景。接着,对我国节水制度建设中存在的问题和不足进行了梳理和研究,总结提炼出以下几个方面的观点:水资源产权虚置、经济杠杆未能得到充分运用、公众参与缺乏体制性渠道、制度体系不配套,法律制度保障不到位、节水技术的研究、发展和应用缺乏制度推动力等等。在对我国节约用水事业发展的现状分析、国外节水制度建设的成功经验,以及构建和完善节水制度的理论进行系统分析、综合归纳的基础上,研究论证了节水制度建设的紧迫性、必要性、可行性。最后,本文从完善新水法中节水制度实施细则、建立水权和水交易机制、保障机制等三方面,提出了构建和完善我国节水制度的对策和构想。在行文中尤其注意突出制度之间的相互配套衔接和操作可行,以期能够为推动我国节约用水工作有所裨益。更多还原

【Abstract】 Recently, with the increasing contradiction between the shortage of water source and economic development, all sectors of society including law society are more and more aware that it is vitally important to save water. This thesis tries to probe the new routes and new ways at the angle of establishment and improvement of law system. Firstly, it describes the research condition of water saving system and provides the background of macro theory for the thesis research from 3 aspects of research condition of water saving system: the research result of water saving system, weak links of theory research and developing trend of the research. Secondly, it gives a combing and researching of problems in the building of water saving system and sums up the following viewpoints: the property nominal position of water source, incompleted used economic lever, the lack of routes for public participation, the lack of systems in the research, development, and appliance of water saving skills, much room needed for improvement of water saving efficiency. It analyses the present condition of water saving and the successful experience of water saving system establishment from foreign countries; constructs and improves the theory of water saving system and proves the urgency, necessity and feasibility of water saving system establishment. Finally it comes up with the strategies and concepts of establishing and improving our water saving system from 3 aspects: improving the rules for implementation of the new law of water; building up the system of water property; water exchange mechanism and safeguard system. In this thesis, it pays special attention to counterpart andjoint between systems, and aims to be helpful to water-saving in our country.更多还原
