【摘要】 拖欠农民工工资不仅严重侵害了农民工的合法权益，而且也影响了社会的稳定、和谐发展。但是拖欠农民工工资问题是由来已久，并有复杂的社会因素。论文在充分的调研基础上，主要研究了如下内容： 1、透视了农民工工资制度，细致分析了农民工工资形式，并采用辨证的观点，不仅对这一制度进行了问题诊断，还对它存在的合理性进行理性的分析。 2、分析了农民工工资拖欠的现状及社会影响，探讨了拖欠农民工工资的多层次原因：农民工工资被拖欠不仅仅是一些包工头“黑心”所致，还有其它复杂的原因。政府项目拖欠工程款、建设单位建设资金不足、施工单位恶意拖欠再加上农民工打工行为不规范、法律保障意识不强以及法律体制的不完善等都是导致农民工工资被拖欠的因素。 3、根据拖欠农民工工资的原因，相应的提出了清欠的策略。由于工程款拖欠是农民工工资被拖欠的重要原因之一，所以提出政府部门和施工单位都要重视工程款的清欠，同时也提出了一些农民工工资的清欠策略。 4、从微观和宏观两个层面系统研究了建立农民工工资的保障机制，建立农民工工资支付保证金制度，实行企业的信用档案制度，严格合同管理。对农民工的社会管理及用工制度进行变革，完善农民工的社会保障体系。 清欠已拖欠的工资并不是我们的主要和最终目的，防止新的拖欠，提高农民工的素质，充分开发和利用农民工的潜能，真正保障农民工的合法权益，改变社会的二元格局，促进整个社会健康、和谐的发展才是最终目标。更多还原

【Abstract】 Default in the salary of peasant workers has not merely encroached on the peasant worker’s legitimate rights and interests seriously, but has influenced the stability and harmony of the society. But it is a long-standing problem; there are complicated social factors. The thesis is on the basis of abundant investigation and research, the main research contents is following:1.Have persecuted the wage system of peasant workers, analyzed their salary form carefully, in the dialectical view, not merely diagnosed this system, still analyzed the rationality that it exists.2. Analyzed the situation and social influence of the default in the salary of the peasant workers, probed into the multi-level reasons of default. It not the mere reason that some foremen are " evil mind "; there are other complicated reasons. Government’s project is in arrears with the project fund, the construction unit lacks funds, unit in charge of construction malicious default, in addition peasant workers seek work irregularly and their lack in the law ensure consciousness, the imperfection legal system are all the factors.3. According to the default reasons, propositioning the tactics to clear up in corresponding. Because the default in project fund is one of the important reasons of the default in the peasant workers salary, having proposed that the government departments and unit in charge of construction should all pay attention to clearing up default in project fund, proposed the tactics of clearing up salary the same time.4. Have studied peasant’s security mechanism of peasant workers salary from two aspect of microcosmic and macroscopic, to set up the Payment earnest money system, implement the credit file systems of enterprises, enforce the management on contract. Reform the workers’ social management and recruitment system; perfect the peasant workers’ social security system.Clearing up the defaults in salary is not mainly our final purpose, to prevent the new delinquency, improve the quality of peasant workers, fully develop and utilize latent energy of peasant workers, really ensure the peasant worker’s legitimate rights and interests, change two- pattern society is the final goal so that to promote the whole society’ s healthy, harmonious development.更多还原
