【摘要】 新《水法》第十二条规定：国家对水资源实行流域管理与行政区域管理相结合的管理体制。在流域水资源管理的法律地位得到明确后，当务之急是构建流域水资源的管理体系。如何深刻理解我国流域水资源管理的历史、现状与发展所面临的问题与机遇，运用国内外的管理理论与成功经验，建立科学、完善并且符合新时期水资源管理特点、要求的流域管理体系，是一个十分严峻而急迫的课题。本文通过对当前我国水资源面临的问题及其成因进行分析，指出造成我国水资源短缺、水污染等问题的根本原因在于我国现行的水资源管理体制欠缺规范管理和法律保障。 本文不仅从理论上论证了建立流域水资源管理体制的科学性和必要性，指出其流域开发治理在我国当前流域体制改革中具有的战略地位，还进一步从流域水资源管理的含义、原则、基本功能等多个角度丰富了流域水资源管理体制的内涵，深化了它的实质内容。通过分析国内外流域水资源管理的发展历程，从而总结了近年来国外流域水资源管理的发展趋势给我国的流域水资源管理体制改革以借鉴。 本文从流域水资源管理体制建设和法制建设两个角度分别论述了我国流域水资源管理的问题及体系构建。在流域水资源管理体制建设中，本文通过分析美、英、法、日、澳等国家流域水资源管理体制的发展历程，指出借鉴发达国家流域管理的成功经验，对推动我国水资源管理体制与国际先进水资源管理模式接轨具有重要的现实意义。而目前我国的流域水资源管理现状还存在着诸多问题，应完善我国的流域水资源管理体制。作者对其进行了体制重构，建议成立综合性的国家水资源管理委员会，下设若干个一级区流域管理委员会，对本流域实行统一规划和管理；通过剥离区域的水权管理职能，形成流域许可管理、区域开发利用的格局。在决策机制方面，流域治理要从简单的技术治理走向包括经济、社会和生态在内的综合治理并应加强公众参与的力度。 目前，《水法》修改不久，相应的配套法规、解释尚未出台，因此，更应作好流域水资源管理专门法律法规的立法研究工作。在本文中，作者试图探讨运用法制手段，将流域水资源管理纳入法制轨道的途径，即实施流域水资源管理立法，建立流域水资源管理法律法规体系。流域水资源管理立法既包括制定专门的流域水资源管理法律法规，也包括在现有水资源法律法规中增加流域水资源管理的相应内容;既要处理好流域与区域的法律关系，又要加强流域水资源管理的执法监督。 最后，理论要通过实践来检验，实践又进一步论证理论的科学性与现实性。本文通过例举福建省在流域水资源管理方面特别是闽江流域的立法与实践工作经验，以做为对本文有关流域水资源管理制度理论探讨的一种呼应。 综上，只有从体制和法制角度对我国水资源管理体制进行创新和改革，才能促进我国水资源管理和保护的可持续发展。关键词:流域，水资源，管理，水资源管理更多还原

【Abstract】 As stipulate in the clause 12 of the term of new water law, water resources management for river basin integrates district management is the water managerial system in China. A river basin is a complex system with a hierarchical structure and integral function. The water system in a river basin not only constitutes a resource base of social and economic development, but also, as a controlling element of ecological system and environment , results in a lot of water and ecological issues. Therefore, integrated water resources management on the basis of a river basin is considered to be an internationally recognized scientific principle at present . In this paper, the implications of basin water resources management is made in both macro and micro contexts .On the basis of analyses of the water crisis, systematically study the implications of basin water resources management, and propose the study content, objectives and the basic functions of the basin water resources management ;summarize the general situations of implementation of and the development of studies on basin water resources management at home and abroad , and sufficiently prove the feasibility and necessity of basin water resources management.This paper summarizes and reviews the institution of the basin water resources management at abroad. Describe the development of the institution of water resources management and the fundamental functions of the river basin organizations in China. By analyzing the basic principles and functions of perfect institution establishment for basin water resources management, this paper proposes a new pattern of river basin organizations.As the water law just revamping , this paper states the important significance to strengthen the legislative establishment for basin water resources management . Summarize the evolutions of water laws and regulations at home and abroad; argue the legal status of basin water resources management . Propose the plan of the legalsystem for basin water resources management; finally , expound the suggestions of implementation of the legal system for basin water resources management.In a general way , no other than analyses the institution and legal system of water resources management , we could accelerate water resources management in China for sustainable development.更多还原
