房地产开发中的法律问题研究

【摘要】 本文在剖析了房地产的概念后，按房地产开发过程的先后顺序，分别阐述了房地产开发用地、房地产施工营建、房地产交易三个方面存在的主要问题。通过国内外立法方面的比较，及对我国房地产开发市场的现状剖析，看到，我国房地产业在取得巨大成就的同时，也存在诸多不规范的问题，有的问题已危及到经济秩序的稳定、金融秩序的安全。为此，有必要借鉴房地产开发市场成熟的国家立法、司法经验，改造我国的房地产用地制度、招投标制度、按揭贷款制度、不动产登记制度等，以促进我国房地产业的健康发展。更多还原

【Abstract】 After an analysis of the concept of real estate, this thesis undertakes an elaboration on the three major issues of land use, construction and transactions of real estate according to the sequence of the course of real estate development. Through a comparative study of the legislation home and abroad and an analysis of the current status of real estate development market in China, while we see great achievements, there are questions of unstandardised practices, some of which are endangering the stability of the economic order and the security of financial order. Therefore, it is necessary to learn from the legislation and judicial experience of mature real estate development market in other countries to improve on the institutions of land use, tendering and bidding, mortgage loans, registration of real estate, etc. so as to ensure a healthy development of the real estate industry in China.更多还原
