我国高等学校学生管理法治化研究

【摘要】 随着社会主义法治进程的深入，法治国家要求高等学校走出法治的真空，对高校来说这是被迫的选择，同时又应是积极主动介入的过程。典型案例表明,学生管理是高校法治薄弱的突出领域。因此，高校学生管理法治化成为该项研究的对象。本研究是规范研究，主要采用文献分析法和比较研究法，并结合典型案例进行实践研究。在认识论上，坚持理性与有限理性相结合。论文体系分为引言、正文、结语三部分。论文主体分为三部分：第一部分，分析高校学生管理法治化内涵；第二部分，分析高校学生管理法治现状，第三部分；进行高校学生管理法治化探索。本研究认为，高校学生管理法治化是高校管理实现法治的过程。它是指高校学生管理按照法治原则，实现学生管理理念从义务本位向权利本位转变，学生管理目标从效率稳定向效益创新转变，学生管理依据从“管理法”向“控权法”转变，学生管理职能从控制向服务转变的过程。通过高校的法治精神、规则和行为方式，体现高校制度文明。高校学生管理法治化的重要意义在于，高校法治是高校自治的根本促进和保障，是高校更好地服务社会、生产知识和培养具有法治素养的公民的体现。更多还原

【Abstract】 With the promotion of law governing, the country governed by law requires universities to go out of the vacuum of law governing. This is a choice forced to university, at the same time it should be a course that universities should actively take part in. Typical cases indicate that student administration in university is still a field “ruled by men”. Therefore, the realization of student administration ruled by “law” in university is chosen to be the target of the research.As a standard study which follows the logical way of thinking of the “problem raising-analyzing-solving”, combining the practice research of typical case, the research primarily uses the methods of literature search and comparative research. Epistemologically, the study sticks to the combination of reason and reason limited. The thesis consists of three parts: introduction, body and summary. The first part clarifies the connotation of the realization of student administration ruled by “law” in university. The second part analyzes the actuality of student administration ruled by “law” in university. The third part does some research on realization of student administration ruled by “law” in university.The realization of student administration ruled by “law” in university in this thesis refers that the administration should apply the principle of law governing and realizes the conversion of the administrative aim from the stabilization and efficiency to the innovation and benefit, the administrative method from “the way of administration” to “the way of power-control”, the administrative function from control to service. The spirit, rules and behavior of “law” governing in university show the civilization of university system. The important meaning of student administration ruled by “law” is that it fundamentality guarantees and promotes university autonomy, and is a symbolization of a university well serving the society, producing knowledge, cultivating high-qualified citizen.更多还原
