竞争法的基本功能研究

【摘要】 对竞争法功能进行的研究，长期以来局限于对竞争法的作用和立法目的的分析。本文借鉴功能主义的分析方式，利用功能分析法对当前竞争法的功能进行了较为全面的论述。 全文共分四个部分。第一部分借鉴功能主义的观点对功能和法律功能进行了论述，对法律作用、法律目的、法律价值和法律功能之间的区别和联系进行了分析，介绍了功能分析法，并利用功能分析法对竞争法功能的研究范围进行了界定。第二部分是文章的中心，主要对竞争法的定义、竞争法功能的产生、竞争法的形式和功能、影响竞争法功能的环境因素等进行了分析，并在最后指出，对竞争法功能的讨论应从正反两个角度来着手，文章论述了当代竞争法的功能。第三部分是有关竞争法功能的发展问题，主要基于竞争理论的发展、经济全球化、知识经济这三个视角分析了竞争法功能的发展新趋向。文章的最后一个部分主要针对当前我国竞争法的功能局限进行研究，并就补救措施提出了自己的建议。更多还原

【Abstract】 Studies in the functions of competition laws is limited to the analysis of competition laws’ actions, legislative intentions in the past years. This paper describes the functions of competition laws comprehensively in the Functional Analysis Way.The thesis can be divided into four sections. The first part is mainly related to the concepts of function and law’s function, discusses the relationships and differences existing in law’s action , legislative intention, law’s value and law’s function, and then specifies the ranges of research into competition laws’ function in the Way of Functional Analysis.The second part is focus of this paper, mainly discussing the definition of competition law, the generation of competition laws’ function, the relationship between its form and function. It ends with two angles, namely, functional and dysfunctional, and then treats contemporary competition laws functions from the two angles.The third part involves in development of the competition laws’ functions. It approaches the latest .tendencies of these functions from three points of view: competitive theory, economic globalization and knowledge economy.The author makes a thorough inquiry into flaws of Chinese competition laws’ functions in the last section of this article, and givessome suggestion about how to deal with those obstacles.更多还原
