【摘要】 乌拉圭回合之后，技术壁垒取代关税壁垒成为主要的贸易保护方式，而技术壁垒从定义上可见其实质为技术标准之争，本文根据技术壁垒的三种类型，从三个方面探讨技术标准向技术壁垒的转化机制：因技术差异和传统习惯造成的转化；因消除消费外部性造成的转化；以贸易保护为宗旨的转化，前两种转化机制导致的技术壁垒以技术标准制订国的综合福利为最终出发点，具有合理性，应该正确对待，并从提高自身技术水平或按要求生产合格商品；对于后一种转化机制，打着合理的旗帜实施不合理的内容，则应通过正当途径、寻求法律援助来解决。经过对技术标准到技术壁垒的不同转化机制分析，从而提出相应具体的解决方案。更多还原

【Abstract】 Abstract: After Uruguay Round, taking the place of tariff barriers technical barriers to trade(TBT) has become a major means to trade protection. From the definition of TBT, we can see it is in fact a competition of technical standards. On the base of three motives of TBT, we will discuss the changing mechanism from technical standards to technical barriers in three fields: changing mechanism caused by technical difference and traditional custom; by erasing externality and by pure trade protectionism. TBT caused by the first two target at overall welfare of the country formulating these technical standards and are reasonable, should be treated in a right way that we should promote our own technical level and produce qualified goods; As to the last one, it is a kind of trade protection with rational banner covering irrational content. Therefore we must take the right approach such as using international law to stand up for our own profit. After analyzing different changing mechanism from technical standards to technical barriers, we can give equivalent solutions according to different type.更多还原
