【摘要】 中国作为一个农业大国，农业对经济发展和社会稳定具有至关重要的影响和决定作用。对于农民这一如此广大的群体、农业这一如此关键的产业、农村这一如此重要的社区，如果任其游离于法治之外，则依法治国只能是空中楼阁。农村问题在中国政治、经济建设中居于中心地位。关注当代中国，就必须关注农村。当代中国的现代化之路，蕴含了法制现代化的内核要求，农村法制现代化的构建，便是中国法制现代化的关键。改革使农村逐步从封闭走向开放，打破了农村固有的利益分配关系，暴露出农村法治中存在的诸多问题，与中国法制现代化的要求仍有很大差距。因此，研究农村法治问题，是时代发展的迫切要求，也是中国现代化进程中不容忽略的问题之一。论文以对法治所下的定义为基础，提出了农村法治这一定义，并在次基础上对农村法治的构成要素及存在的主要问题做了逐一的分析和论述，重点放在了农村法治组织—村民委员会、村民自治中存在的问题。论文试图分析农村法治的趋势和提出解决问题的途径和方法，并进一步强调了农村法治在社会主义政治文明建设中的地位。更多还原

【Abstract】 China is an agriculture country and agriculture plays a very important role to the development of economy and the stable of society. Farmers, agriculture and rural area are very important. If they are out of control of rule of law, then it will be empty talk to rule the whole country by law. The issue of rural area is the core of politics and economy. Pay attention to China, we must pay close attention to rural area. The road of modernization has the content of legality and the key of legality is in rural area. Reform makes the rural area open the door and changes the distribution of interests and exposes many problems of rule of law in rural area which still has a long way to go. So making a study of the issue of rural area’s rule of law is the requirement of time and it is also very urgent. The thesis bases on the definition of rule of law and points out the definition of rural area’s rule of law and analyses the essential factors and some problems which mainly discusses the villagers committee and the villagers autonomy. The thesis tries to analyze the trend of rural area’s rule of law and puts forward the ways and approaches to solve them and also emphasizes the importance of rural area’s rule of law to the civilization construction of socialism politics.更多还原
