软件知识产权保护研究

【摘要】 计算机软件是一种智力产品,由于其极易复制,使得对其的侵权现象十分严重。盗版是软件侵权的主要形式之一,它给企业造成了巨大损失,极大地危害了软件产业的发展。这使得软件知识产权保护问题变得日益突出。本文从法律和技术两个方面,以技术为重点对软件知识产权保护做了研究。在法律方面,本文研究了运用法律进行软件知识产权保护的一般问题,给出了企业运用法律武器保护软件知识产权的策略和建议;在技术方面,本文研究了软件知识产权保护的基础技术及其具体实现方法,分析了常见的软件保护产品,提出了软件知识产权保护的理想技术方案。在这些研究的基础上,本文提出了一种新的基于公钥算法的软件知识产权技术保护方案,并给出了用伪码表示的算法。本文最后构建了一个集成的软件加密系统XGuard,并对其进行了代码实现。

【Abstract】 Computer Software is a type of intelligence products, the tort is serious to it because of its easy duplicate. The piracy is one of the main tort forms; it has caused enormous losses to the enterprises and has harmed the development of software industrial. That makes the protection for software intelligence property outstandingly. This article studied the problem from the aspect of law and technology, and the latter is major. On the aspect of legal, common problems are studied and policies are given for better protection of the software intelligence property; On the aspect of technology, basic technologies and its implementation for the software protection is studied, and some common software for software protection are analyzed, and the ideal technical scheme for software protection has been proposed. On the basis of these researches, a new technical scheme based on public key for software protection are proposed and its algorithm is also given showing in pseudo code. Finally, a integrated software encrypt system named XGuard is built and has been implemented by programming language.
