【摘要】 家庭暴力，作为一个敏感的社会问题。长期以来，为社会伦理道德、传统文化观念所束缚，这个“雷区”一直少人问津。上世纪60年代，家庭暴力问题在西方国家逐渐成为人们关注的热点。我国学者从1995年“世妇会”后对这个问题进行了系统的研究，介绍了大量的西方理论，并运用西方的理论对中国的相关个案进行实证分析，取得了一定的成果。由于目前我国与家庭暴力相配套的法律制度尚不健全，对家庭暴力的界定和家庭暴力行为的性质认定仍存在诸多争议，这既损害了家庭成员的身心健康和合法权益，也不利于婚姻和家庭的稳定、社会秩序的和谐与发展。 本文希望在借鉴已有研究成果的基础上，结合中国的国情，对中国的家庭暴力犯罪进行初步、系统的探讨。深入研究经济、文化的发展进步，社会的变革与中国传统文化滞后产生的矛盾对家庭暴力问题的影响，对家庭暴力的形成原因进行剖析，并在此基础上，提出有针对性的预防和控制措施：完善我国的反家庭暴力立法，制定家庭暴力案件专门的诉讼方式和证据规则，借鉴国外的保护令制度，赋予公安机关和司法机关发放“保护令、禁止令、赔偿令”的权力。充分发挥公安机关和警察在处理家庭暴力事件中的主导作用，建立“家事法庭”，适用特别程序审理家庭暴力案件，加强司法控制。同时发挥社区、街道办事处、居委会及社会组织的作用，建立配套的社会保障和救济体系，司法控制与社会预防并举，杜绝家庭暴力犯罪现象的发生。更多还原

【Abstract】 Domestic violence, a sensitive society problem, being restrained by society morality and traditional culture, few persons got in touch with it. It has not caused widely social concerns in the western countries until 1960’. In China, domestic violence is still a new recognized field. It didn’t attract the public attention until the 1995 World Conference on women in Beijing. Since then, a lot of theories on the research trends in. the world were introduced. Combining international theories and methods with the factual example in China, Some scholars got notable results in the field. However, there are few relevant law march with domestic violence crime, lots of dispute about domestic violence’s concept and character. It damages seriously the victims’ health, infringes these lawful rights and destroys marriage and family’ stability, affect social order harmony and development.The author hopes to apply the knowledge and results which scholars get in this field, combined with the situation of China, study the domestic violence crime. Researching the conflict between the development of economy and culture with the traditional civilization, analyzed the cause of domestic violence crime formation. Based on these findings, some implications for social prevent and measures for juridical control have been raised: Prefect anti- domestic violence legislation, formulate special lawsuit and evidence rule for domestic violence crime case, learning protection order regulation from foreign countries, endow the police and judicial authority the power with "protection order, forbidden order, compensation order". Exert the leading role of police in the occurrence of domestic violence. Establish "domestic count", trial with special program. Strengthen judicial control, exert the social group faction. All round social support system must be built up. Juridical control and social support are all requited, These measures will benefit for the domestic violence put to end.更多还原
