【摘要】 本文紧密围绕数字环境探讨版权集体管理。笔者运用理论分析、实际调查和数据分析相结合的方法，论述数字环境对版权集体管理制度本身、版权集体管理组织活动等的影响，提出数字环境下切实可行的集体管理方案。论文共分五部分： 第一部分：版权集体管理概述。首先分析版权集体管理产生的原因和发展的情况。然后介绍版权集体管理的概念、原则、内容等基本问题。最后通过分析数字环境的特征，从版权保护的客体、主体、内容、手段等方面入手，分析数字环境给版权集体管理带来的机遇和挑战，目的在于论述数字环境下版权集体管理的必要性。 第二部分：数字环境下版权集体管理的优势分析。从维持版权平衡、经济、技术、管理的角度分析版权集体管理在数字环境下的优势，充分说明版权集体管理在数字环境下的可行性。最后通过介绍一些国际性、国家性的版权集体管理组织应对数字环境采取的有效措施，进一步辅证数字环境下集体管理的可行性。 第三部分：数字环境下版权集体管理的适用情况分析。版权集体管理无论在什么时候都是有一定适用范围的，数字环境下版权集体管理的适用范围肯定会有所变化。通过分析数字环境下版权保护出现的新情况，探讨这些新情况哪些适用集体管理，哪些不适用集体管理，以及如何适用集体管理。 第四部分：数字环境下构建我国版权集体管理体系的设想。探讨数字环境下版权集体管理的方法问题，结合我国的实际情况，从建立版权管理网络、重组版权集体管理组织、开发版权管理信息系统等方面考虑，提出构建我国版权集体管理体系的设想。 第五部分：结论。更多还原

【Abstract】 This paper discusses about collective management of copyright under the digital environment. Using the synthetic means of theory analysis, fact research and data analysis, it analyzes the influence of digital environment on collective management of copyright system and collective management organizations etc. In the end, this paper puts forward feasible suggestions of collective management. The text comprises 5 parts:The first part is the summary of the collective management of copyright. First, the causes of collective management of copyright and its development are analyzed. Then, the concept, principle and content of collective management are introduced. Finally, in order to discuss the necessary of collective management, the author points out the opportunities and challenges of collective management of copyright under the digital environment through analyzing digital environment’s characters.The second part tries to analyze the advantage of copyright collective management under the digital environment. From the perspective of copyright balance, economy, technology and administration, the paper discusses the advantages and feasibility of collective management under the digital environment. Lastly, the author introduces some effective measures taken by some international collective management organizations and some national collective management organizations to solve the problems under the digital environment. And the feasibility of collective management can be proved ulteriorly by these measures.The third part investigates the conditions, which are applicable to collective management of copyright under the digital environment. Whenever, there is a certain range available of collective management of copyright. Undoubtedly, its applicable range will be changed when it is faced with the digital environment. This part analyzes the new conditions whether or not applicable to collective management of copyright, as well as how to use collective management of copyright.The fourth part puts forward the assumption of setting up the system of collective management of copyright in our country. The problems on the methodsof collective management of copyright are discussed in this part. According to our facts, it conceives of the system of collective management of copyright in our country by considering of the building of copyright management network, recombination of collective management organizations and development of copyright management’s information system.
