【摘要】 垄断源于市场竞争，是与竞争相对应的市场经济现象。垄断将导致市场失灵，从而成为政府采取规制手段干预经济的原因。 行政垄断广泛存在于处于市场化进程中的发展中国家，转型时期的中国也不可避免地存在着大量的行政垄断现象。行政垄断减少社会福利，诱发腐败，也影响经济增长，削弱国家竞争力，因此，人们要求政府反对行政垄断的意愿强烈。另一方面，作为反垄断的重要手段，我国政府规制的实行效果却不理想，规制失灵加剧了行政垄断的形成和蔓延。 本文将国内对行政垄断的研究成果与国外规制经济理论相结合，将行政垄断与政府规制联系起来研究，透过现象来找寻两者之间的内在关系。通过对行政垄断主体与规制主体的特征分析，本文揭示了两者间隐含的利益共存机制，进而从新的角度解释了行政垄断现象，为反对行政垄断，规范政府行为，建立良好的竞争环境提出了相应的政策建议。更多还原

【Abstract】 Monopoly originates from market compitition. Corresponds to competition, monopoly is a phenomenon of market economy. In the mean time, monopoly leads to failure of market. So, it become one of the reasons which causes government regulate economy.Administrative monopoly widely exists in the developing countries experiencing establishment of the market economy, so does our nation China ineluctably during the mode-change period. On the one hand, administrative monopoly reduces social welfare, stimulates corruption, decreases the growth of economy, and weaken national competitiveness, therefore, the govermant is requested intensively to oppose administrative monopoly. On the other hand, as the important method against administrative monopoly, China’s government regulation does not work efficiently, the failure of the regulation worsen the situation of administrative monopoly.The study integrate the domestic researth of administrative monopoly with the theories of regulation economics, connect administrative monopoly with government regulation, in order to find the inside relationship between both of them. Through the analysis of the characteristics of administrative monopoly and government regulation department, we discover the crytic benefit-share institution of them.Then our study explain the phenomenon of administrative monopoly from a new angle,and make some suggestions to eliminate the administrative monopoly, rectify the government regulation action, maintain the competitive circumstance of market economy.更多还原
