【摘要】 我国招投标制度实施已有二十年之余，并日趋成熟，它为我国建筑市场提供了强大的机制支持，同时也促进了基本建设的成长。但近年来，招投标也暴露出很多的问题，各种违规事件层出不穷，寻租活动频发，这些现象在某种程度上阻碍了招投标有效性的充分发挥。 论文从现代经济学的寻租理论分析我国转型经济中建筑市场的寻租活动。建筑市场其实是一个“寻租场”。建筑市场寻租行为的成因对我国建筑市场寻租行为的成因进行了基础的经济学分析，认为市场失灵和政府失灵两种制度缺陷是寻租行为产生的根本原因；建筑市场的特殊性则是我国建筑市场寻租行为产生的特殊原因。建筑市场寻租行为的危害从经济原理上表明了寻租行为产生后建筑市场的工程质量、市场效率、市场结构及行业发展的变化，阐明了寻租行为的危害。 为进一步研究寻租的产生机理和现实状况，本文以西安市的违规处罚决定为样本和典型取样法为研究方法，应用决策论和博弈论，结合建设寻租的特点，创设了有关假设条件和参数，建立博弈模型。实证研究结果表明，近年来，我国招投标管理的寻租处于高频率状态，有关处罚规定在现实中没有得到严格的实施，惩罚力度不足以有效遏止市场的寻租冲动，在市场有效监管上，不仅稽查的概率偏低，而且稽查的成功率也有待提高，合理改进稽查概率、稽查成功率、惩罚力度等相关参数，是提高市场效率的有效途径。由此，本文认为工程招标制度的培育和发展对于规范建筑市场交易行为，维护招投标方的合法权益，保证建筑工程的质量和安全具有重要作用。并在上述理论和实证分析基础上，对招投标管理从政策、寻租主体、监管等角度对提出具体的对策与建议。更多还原

【Abstract】 The system of bid of our countiy has been implemented already for 20 years, and becoming riper, it has offered the strong mechanism for market of building of our country to support, promoted the growth of capital construction at the same time. But in recent years, bid exposes a lot of questions, various kinds of incidents in violation of rules and regulations emerge in an endless stream) Rent-seeking take place frequently, these phenomena have hindered the further improvement which give full play to bid validity to a certain extent.On the base of rent-seeking thesis of modern economics> the paper analyzes rent-seeking activity of the transition economy in our building-market. The building market is actually the field full of rent-seeking. "The rent-seeking behavior in construction-market" takes the causes of rent-seeking of our country on the fundamental economics analysis. It thinks the market failure and government failure is the basic reason that the behavior produces. The particularity of the building market is the special reason why the rent-seeking behaviors produce. "The rent-seeking Consequence effect on the project quality, the market efficiency, the market structure and trade development , through on the rent-seeking economic models and principles it indicated the danger of rent behaviors.Propose with is it build system frame come structure building seeking the behavior of renting at the market to plan, promoting the perfection building regulation, system, social environment, and trade in the bid course must take market-based reform as the direction, information was disclosed, the norm was fought for unexpectedly, structured the system of building according to the demand for market economy law, promote the sound development of the building market.For farther research in practical status and birth mechanism of rent-seeking, the thesis usesdecision-making and game theory to build game model, adding some hypothesis and parameter. Use typical sampling with punishes decision from construction committee of Xian, and does positive research. Result shows that from those years rent-seeking have been in a high frequency state, many prescripts of construction management laws have not been enforced well on checking of lawless cases, degree of punish cant hold back the rent-seek-in imposing. At the effective monitor of construction market, not only probability of check is low, but rate of succeed is low too. Improve probability of checking, check success rate, relevant parameters of punishing dynamics etc. rationally; it is the effective way of improving market efficiency. Therefore this text think the cultivation and development of biding mechanism for standardize building market trading activity, safeguarding the square legitimate rights and interests of bid, the quality and security which guarantee the construction work have important function. Moreover, on the base of theory and positive research, the Principle bring forward concrete countermeasure and suggestion to renovate rent-seeking of bid management, and table some proposal from the aspects of policy, rent-seeking main body and monitor.更多还原
