论法律移植与当代中国法制建设

【摘要】 法律移植是一个常用概念，而对它的理解却多有不同，本文试从语义、历史两种视角加以分析，进而指出它的三种形态和两种方式。面对当代中国的社会新形势，法律移植无疑是客观的现实选择，它是应发展市场经济、改革政治体制、对外开放、人权发展、实现法制现代化之所需而必然发生的。与此同时，它也具有相应的人文环境，如经济环境、法制环境、文化环境等。作为法律文化中的一种常见现象，法律移植贯穿于中国近代以来的各个历史阶段。无论是清末法律改革、民国法制变革，还是社会主义法制革新，每一步都印有法律移植之痕迹，而每一步又都并非坦途一片。无声的历史给了我们后人太多宝贵的启示，有声的现实一面以史为鉴，一面又呈现出一些突出问题。可见，法律移植实是一项艰难的工程，而如何完善法律移植，建设好这项工程，本文将着重予以探讨，并试从科学原则、主要内容、具体途径三个方面加以阐述，希望最大程度的发挥法律移植的重要作用，以促进当代中国的法制建设。更多还原

【Abstract】 Most of the understanding about the legal transplant used often is different from each other. The dissertation tries to analyse the conception from two angles of view: the word’s meaning and the history, and then points out its three morphologies and two patterns. Facing the new social situation of contemporary China, the legal transplant is the objective and practical choice, is of necessity adapting to the need of developing market economy, reforming political system, opening to the outside world, improving human rights, realizing modernization of law. At the same time, it lies in the corresponding humanistic circumstance, such as the economic circumstance, the legal circumstance, the cultural circumstance and so on. Since the modern times, the legal transplant that is a usual phenomenon in the legal culture runs through every historical stage. Among the legal reform of the Qing Dynasty, the Chinese People’s Democratic Government and the socialist China, every stage marked with the legal transplant is not smooth. The mute history gives us too much valuable enlightening guidance, and the reality takes warning from the history on one side and appears some projecting problems on the other side. So we can see that the legal transplant is really a difficult engineering. To bring the important role of the legal transplant into full play and promote the construction of law of contemporary China, the dissertation expounds how to make the legal transplant perfect and how to construct the engineering well on scientific principle, main content and particular way.更多还原
