【摘要】 行政指导一词出自日本行政实务，它是一个行政实践中的用语，本不是学术上和法律上的概念。行政指导进入法学者的视角是由于它在日本经济腾飞中起着无可替代的作用。行政指导并不是自古就有的，而是社会历史发展到一定阶段的产物，它与市场经济，尤其是全球化经济的发展有着深刻的内在联系。行政指导的出现和发展，与人们对市场和政府的作用、局限及相互关系之认识过程密切相关，是这一认识过程不断深化的产物。随着经济全球化的发展和WTO的建立，各国的行政指导存在着日益融合的发展趋势。作为服务行政的一个重要方面，行政指导彰显了行政法服务内容的重大变迁，使传统的依法行政原则面临着新的挑战。文章从行政指导“法治化”的现实需要出发，在不改变现有行政法学理论框架的前提下，从纷繁复杂的行政指导现象中，提炼出一个新的概念——利益诱导型行政指导，并通过一番论证，揭示了利益诱导型行政指导异于一般行政行为的特征。规范好利益诱导型行政指导，就等于抓住了行政指导“法治化”问题的主要矛盾，对于促进我国行政法治的发展具有重大的意义。文章根据“有救济才有权利”的现代法治理念，对利益诱导型行政指导的救济制度进行了大胆的设计，力求使利益诱导型行政指导的救济制度变得更为具体可行，富有成效。更多还原

【Abstract】 The term administrative guidance comes from Japanese administrative practice. It is terminology of administrative practice, and is neither academic terminology nor judicial terminology. Because it played a uniquely important role for the prosperity of Japanese economy, jurists began to attach importance to it. Administrative guidance didn’t exist in the ancient, but was the outcome of a certain historical period. There is deeply inner relation between administrative guidance and the development of market economy, especially, of globalization economy. The appearance and development of administrative guidance have close connection with the process of people’s understanding about the function limitation, correlation between the market and government, and is also the outcome of deepening understanding. With the development of globalization economy and the establishment of WTO, administrative guidance of nations trend to mix together increasingly. As an important aspect of service administration, administrative guidance shows the great change of the content of service administration, and it makes the traditional principle of administration by law face new challenge. To meet actual needs of rule of law on administration, and under the current theoretical framework of administrative jurisprudence, the article puts forward a new concept of interests-oriented administrative guidance from the complicated phenomena of administrative guidance, and reveals the features of interests-oriented administrative guidance different from that of the common administrative action. To standardize the interests-oriented administrative guidance means to grasp the principalcontradiction of rule of law on administration, and it is also of great significance to speed the development of rule of law on administration for China. According to the faith on rule of law accepted by people nowadays-only the one who is relieved has legal rights, a relief system for interests-oriented administrative guidance is designed courageously, to try to make it more practical and effectual.更多还原
