【摘要】 司法官吏职务犯罪首先是一个重大的法制问题。宋代统治者在法律上明确规定了官吏司法审判责任。这些责任制度严密而科学，涉及司法官吏在诉讼审判活动中各个环节，内容包括：诉讼受理责任，司法审判责任，狱囚管理责任，判决出入的追究，宋代法官责任体系一方面继承了我国诉讼制度的优良传统，另一方面也充分体现了宋代体时适变，自立一王之法的特色。 同时，司法官吏职务犯罪又是一个重大的吏治问题。宋代统治者又制定了各项防范措施，以避免官吏审判时徇私枉法。这些措施包括：重视法律考试以提高官吏业务素质，加强官箴教育以提高官吏思想道德素质，完善审判约束机制，强化司法监督机制。这样形成内外相制，标本兼治的防治措施有效的澄清了司法吏治。 尽管宋代统治者制定了严密的责任制度和防范措旌以防治司法官吏职务犯罪，但事与愿违，他们拒案而坐，执笔而判，虽知明有国宪，幽有鬼神，视官箴于不愆，视国法于不顾，或官不躬亲，或违法受理，或惨虐讯囚，或淹延系囚，或枉法曲断。林林总总的司法官吏职务犯罪现象植根于宋代社会急剧变化的大背景中，其法繁之弊，官制之弊，吏奸之弊等等都加重了宋代司法的黑暗。而封建人治社会权大于法的政治特点决定了法吏职务犯罪根本无法消除，宋代亦然。更多还原

【Abstract】 Firstly the judicial officials often had criminal offence through their powers is a great matter of law system. So, the ruler of Song Dynasty defined the officials duties in the judicial action, made perfect and strict institution of duty, whic involved each process from receiving the plaint to sentence to finishing the case. In them, the main duties showed fully the greatest lawful achievement and unique style in Song Dynasty.Secondly, the judicial official violating the law through their powers is also a important matter of government’ s managements. So, the rulers of Song Dynasty also established all kinds of defensive methods to prevent the officials from abusing their authority for their own private benefits, which include: paying importance to law ests in order to develop the official’ s vocational quality and intensifying the education of their thoughts and virtues to improve the officials’ moral quality and perfecting the mechanism of restriction or supervision against abusing judicial organ.. The methods of being on guard from outer to inner and from face to essence for the judicial officials gained great effects in Song Dynasty.However, in spite of the upward methods, there were a great deal of phenomenon of breaking the law in the officials’ judicial procedure. The main reasons were the malpractice of many laws and incompetent officials in Song Dynasty. Nevertheless, the whole feudal society cannot root such phenomenon. It was the same as Song Dynasty.更多还原
