【摘要】 工程担保是工程合同履约风险管理的有效手段，通过工程担保，在被担保人违约、失败、负债时，债权人的权益得到保障。 工程担保在西方工业发达国家已形成一套完整的体系，有一套健全的操作机制。在我国随着经济的发展和外资的涌入，也已经开始了工程担保的探索与实践。 本文在研究国外工程担保做法的基础上，首先简要介绍了工程担保的概念、方式、工程担保与工程保险的区别，以期正确把握工程担保制度的基本内涵。 针对我国建筑市场现状，结合我国工程担保的实践，论述了我国工程担保制度担保模式的选择与运行机制的建立，提出了建立我国工程担保制度的政策性建议。最后介绍了青岛市开展工程担保制度的情况，并提出相关建议。 论文对于在我国推行工程担保制度，进行工程担保立法，规范工程担保的具体行为具有一定的借鉴意义。更多还原

【Abstract】 Construction bond is one of the effective means for fulfillment risk management ofconstruction contracts. By these means, the benefits of an oblige can be warrantedwhen the debtor is in default, debt, or failure.In western industrialized countries, a set of organization systems and operationsystems for construction bond have already been set up. With the economicdevelopment and the pouring of foreign investment, the research and practice ofconstruction bond have begun in China.On the basis of the study on the practice of construction bond in western countries,this paper makes an analysis in construction bond from its concepts and contracts toconcrete operation and management.Combining with China’s construction bond practice. This paper makes an analysis inchoosing the classifications of construction bond and operating. This paper also givethe suggestions for the establishment of construction bond system in China.This paper may serve as reference for construction bond study, as well as reference forthe construction bond practice in China.更多还原
