【摘要】 在对河北省承德市丰宁满族自治县及唐山市迁安市(县级市)和滦南县的农村社区的私了现象调查的基础上，本研究深入分析了农村社区私了的现状、分类及原因，并着重探讨了私了过程中的国家法与民间规则的互动，认为： 作为纠纷的解决方式，私了本质上首先是一种非诉讼的民间纠纷解决机制，它可以经济、方便、迅速解决纠纷，并且在纠纷解决过程中能够较好地维护先前的和睦关系，保护当事人双方的面子，有利于维护社会稳定。现阶段农村社区的私了作为多元化纠纷解决机制中的一种纠纷解决方式仍有现实意义，在限制其副作用的前提下应给予合理的发展空间。 在农村社区，国家法与民间规则存在着互动与冲突，正确的方法是要对国家法与民间规则进行必要的互动与整合。尽管国家法也有弊端，甚至在某些方面不及民间规则有效，但从依法治国和社会发展的大趋势讲，国家法应成为我们的发展目标。政府通过强行手段推行国家法在农村社区实施时，必须注意到国家法与民间规则的这种互动与相容关系。更多还原

【Abstract】 On the basis of social survey on siliao in the rural areas of Fengning Manchu Autonomous County of Chengde, Qian’an and Luannan of Tangshan, this research deeply analyzes the present status sorts and reasons of siliao in the rural areas of Hebei Province, and specially discusses the interaction between the national law and folk rules in siliao.As a way of solving dispute, siliao essentially is a non-litigation folk mechanism. It can solve the dispute economically and quickly, and well maintain the former harmonious relationship between both parties. This is in favor of the maintenance of social stabilization. At present, siliao is still very important in the dispute solving system of rural areas. It should be given reasonable developing space under the condition of limiting its negative effects.In rural community, there are interaction and conflicts between the national law and folk rules. The correct way is to achieve necessary conformity between these two things. Although the national law has abuses and is not as effective as folk rules in some aspect, it should be the aim of the social and law development. When implementing the national law by force in rural areas, the government must realize the interaction and conformity between the national law and folk rules.更多还原
