【摘要】 传统上，学界对违约责任中的精神损害赔偿持否定态度，本文从一则典型案例入手，用实证和价值分析的方法，对精神损害赔偿在违约责任中存在的必要性和法理基础作了论述，并对其适用时可能出现的各种问题提出了相应的解决方案。本文在结构上共分为三大部分。第一部分从对否定说主要理由的反思和对其他国家(地区)立法、学说及相关判例的考察中，论证了违约责任中应有精神损害赔偿。并对支持精神损害赔偿的传统理论提出质疑，阐释了在违约责任中适用精神损害赔偿的机理在于精神利益的损失造成精神损害，论述了在违约中对精神损害进行赔偿的必要性和法律政策基础。在对各种情况进行分析的基础上，本文第二部分提出了违约责任中精神损害赔偿的三大构成要件：损害事实、违反合同的行为、违约行为和损害事实之间的因果关系。并对当事人主观上是否需要有过失作了探讨。该部分还总结了现有各种精神损害赔偿计算方法，在对其作了相关评述后，提出了对违约责任中精神损害赔偿具体数额进行计算的方案。在第三部分，本文还对违约责任中精神损害赔偿可能出现的滥用作了论述，并提出了相应的法律控制对策。更多还原

【Abstract】 Traditionally, it is thought that spirit damage is not recoverable in contract. From a typical case, this dissertation discusses the necessity of it in reality and reasons of basic theory by applicatting real evidence-analytic method and evaluation-analytic method. Also the dissertation illustrates how to employing spirit damage in liability of breach faith and put forward correspond resolutions on different situations.In order to analyze this problem, the dissertation is divided into three chapters. The first chapter make conclusion that the liability of breach faith should include spirit damage by reviewing the main reasons about denying the spirit damage in liability of breach faith and studying other countries(areas) ’s legislation theories and cases. At the same time, the author oppugns the traditional affirming spirit damage theories, and indicates that the mechanism of compensation of spirit damage is the losing of spirit benefit form the spirit damage, it is necessary to compensate by the law policy.On the basis of analyzing different situations, the second chapter proposes three composing essential condition of spirit damage in liability of breach faith: the facts the behavior and causality between the facts and behavior. And explain whether the defendant’ fault is necessary. This chapter also concludes eight accounting ways of spirit damage. After reviewing them, the author puts forward appropriate ways of accounting spirit damage’ amount in liability of breach faith.In the third chapter, the dissertation points out the possibility of abusing spirit damage in liability of breach faith.
