【摘要】 我国已于2001年12月正式加入WTO，这将使我国技术型企业参与国际竞争面临着许多机遇；但与此同时，加入世界贸易组织，我国知识产权法律制度的保护水平应当提高到世贸组织所要求的程度，同时入世所引起的环境方面的巨变，也给我国技术型企业带来了极大的挑战。WTO的加入，外国著名企业将长驱直入中国市场，我国技术型企业将在家门口面对面地同具有技术优势的国外企业进行竞争，并遵循着同样的游戏规则，承受社会、文化、伦理等环境变化而带来的压力，因而在中国技术型企业中纳入专利战略管理已显得极为必要。 在竞争越来越激烈的今天，专利工作在企业中的重要性也越来越强。专利工作的好坏直接决定着企业能否建立核心竞争力，从而在国际竞争和技术较量中披荆斩棘，纵横驰骋。而在当前，我国技术型企业的专利战略管理现状不容乐观，绝大多数企业专利意识淡薄，不重视专利申请和专利保护，更谈不上把专利管理提升到战略的高度，入世之前，中国技术型企业已在专利战略管理上处于下风，入世之后，中国技术型企业如果不迅速采取相应的措施，制定适合本企业的专利战略，并将陷入严重的专利危机，并为此付出巨大的代价，前不久发生的美国企业向中国DVD生产厂商索要专利许可费以及日本对中国摩托车企业的封杀事件，已为广大的中国技术型企业敲响了一记警钟。因此，中国技术型企业必须马上转变观念，将企业中的专利工作提上日程，上升到战略的高度，探索具有本企业特色的专利战略，并予以有效的实施和严密的控制。 本文系统论述了在加入WTO的背景下，中国技术型企业所面临的环境方面的诸多变化；在伴随入世所带来的许多挑战的同时，为了建立核心竞争力、在激烈的市场竞争中获取竞争优势，中国技术型企业应选择什么样的专利战 四川大学硕士学位论文略？如何对专利战略进行有效管理和运营？专利战略如何实施？实施过程中如何对专利战略进行有效控制和评价？本文作者在这些方面进行了仔细的思考，在借鉴前人研究结果和对若干行业进行调研的基础上，提出了作者对于中国技术型企业专利战略管理方面的一些研究成果。希望能通过这些研究，为中国技术型企业的专利战略管理提供有益的参考。更多还原

【Abstract】 China became one of the official members of WTO on the day of December 11,2001. It takes many chances to our Chinese technology enterprises,however the protect level of our law systems in knowledge property right are also required to reach the standard which WTO requires,simultaneously. The entering of WTO is sure to give rise to great changes in environment,which will take bring challenges to our high-technology enterprises. With the entering of WTO,many foreign famous enterprises will drive straight in Chinese market and our technology enterprises will competent with them face to face. The same rules will be obeyed and great pressures in society,culture,ethics etc. will be faced. Thus,it has been very important and urgent that Chinese high-technology enterprises should practice patent strategy management.With the degree in the competition increasing,the importance of patent work increases relevantly. The goodness or badness of patent work will decide whether an enterprise can construct key capability of competition,with which an enterprise can develop and make progresses. However,the present conditions of patent strategy management in Chinese high-technology enterprises are not satisfying. Most of them are short of patent consciousness,pay no attention to the application and protection of patent. Thus,the present condition of patent management is too far from the altitude of strategy. Chinese high-technology enterprises have been in the weak position before entering WTO. After entering WTO,if the corresponding measures and the proper patent strategies are not adopted immediately,they will sink into thepatent crisis deeply and pay great painful prices for it. Whatsoever,Chinese high-technology enterprises must renew minds,get the patent work into schedules,search for the proper patent strategy and put into effective practice and tight control.This article systematically expounds the various change of environment after entering WTO which Chinese technology enterprises face. With the appearance of great challenge brought by the entering of WTO,in order to construct key capability of competence,what patent strategies should be taken by Chinese high-technology enterprises? How to put patent strategies into effective management and operation? How to practice the patent strategies? How to take effective control and evaluation in the patent strategies during practice? The author made careful considerations in the above aspects. On the basis of present research results and investigations in various industries,the author provided several research results in the aspect of patent strategy management in Chinese high-technology enterprises. Through the research,benefiting reference can be provided to the management of Chinese high-technology enterprises.更多还原
