【摘要】 随着我国保险业的不断发展，保险深度和密度的不断加大，保险在国民经济中的地位日益重要。但是保险法律的不完善、保险当事人法律意识的厥如导致保险纠纷、保险欺诈越来越多。这些现象产生的原因主要集中在保险合同当事人没有忠诚善意履行合同义务。保险合同是最大诚实信用合同，研究保险法之诚信义务，不仅可以使保险合同当事人和保险合同辅助人明确其义务而切实遵守之，也可以为解决保险纠纷、防范保险诈骗提供法律依据。本文介绍了保险、保险合同及保险法的相关内容，对保险的概念和特征做了分析，总结了保险合同与保险法的特征。深入探讨了保险法中的诚信原则，追溯了诚信原则的发展历史，论述了其在保险法中的体现。并在比较各国保险法之诚信义务的基础上总结出保险法上诚信义务的内容，包括投保人、保险人、保险代理人与保险经纪人的诚信义务，着重介绍了我国保险法之诚信义务及其实现，介绍了我国保险法对诚信义务的有关规定，并对目前存在的实现障碍与对策做了分析。笔者通过对保险及其法律特征的阐述，侧重就诚信义务在保险法中的广泛内涵予以研究，旨在从历史和现实的角度，诠释诚信义务的方方面面，尤其对当今违反诚信义务的行为，以及如何克服这些行为，联系实际进行学理的探讨，以期使保险法在实践中更好地发挥作用。更多还原

【Abstract】 With the development of Chinese insurance industry, the increase of density and profundity of insurance, insurance industry has got an important status in the national economy. Defection of the insurance law and the absence of legal sense in insurance litigant result in more and more insurance dispute and deceive. These phenomena are mostly caused by the insurance litigants’ execution without fidelity and good faith. Insurance contract is utmost good faith contract. Research of the good faith duty in insurance law can not only express the duty clearly to the insurance litigants and assistants, but also apply legal foundation for settlement of insurance dispute and guarding insurance deceive.The article introduces insurance, insurance contract and insurance law, analyzes the concept and character of insurance and concludes the character of insurance contract and insurance law. The author probes into the good faith principle of insurance law, elucidates its developing history and the related regulations in insurance law. She makes comparison of good faith duty among abroad insurance law, including the good faith duty of the applicant, the insurer, the insurance agent and the insurance broker. The article analyzes good faith duty and its execution in Chinese insurance law, elucidates the obstruction and countermeasure for carrying out the good faith principle.In a word, the author probes into the good faith principle in insurance law in order to elucidate the good faith duty all-sidely, analyzes the cause and countermeasure as well as related theory to make the insurance law more effective in practice.更多还原
