【摘要】 随着世界贸易自由化程度的不断提高，货物、技术和服务的跨国流动均较以前有了大幅度的增长。生产要素跨国流动日益自由方便使得企业产品的研发、生产和销售可能会在不同的国家和地区完成。而且，随着各种贸易壁垒受到压制或取消，有许多不公平竞争行为正悄然进入贸易领域，使得贸易规则与竞争规则联系的越来越紧密。在这些变化了的经济新形势下，以致力于国内市场为规范对象的各国竞争规则已难以适应实际需要。各国在竞争规则的制定、实施方面发生法律冲突的地方也会越来越多。为了避免或消除这些法律冲突，国际社会采取了各种方式以达到竞争规则的国际协调。相比较而言，以签订双边协定和区域性协定的形式进行竞争规则国际协调的，其协定内容大多数为专门性的，即仅从竞争规则的角度出发，很少考虑贸易规则。而以签订多边条约为途径的，则多结合了贸易规则。本文在分析了贸易规则与竞争规则的特征、内容及其联系与区别等方面；比较了双边协定、区域协定和多边条约三种模式的优劣之后，得出了这样一个结论：要适应全球经济一体化的要求，竞争规则的国际协调不能不考虑贸易规则。应该发挥竞争规则和贸易规则的互补作用，避免或减少这两者之间的冲突，因而，竞争规则的国际协调必然要在多边贸易体制中进行。而就目前来说，在WTO体制中实现竞争规则的国际协调是其最终归宿。更多还原

【Abstract】 With the integration of world economy,the flowing of goods,technology and service transnationally increased rapidly. Under such conditions,the products’ R&D,producing and selling can be conducted in different countries. Moreover,with many trade barriers being cutting off,more and more non-just competition activities are slipping into trade field,so the relationship between trade rules and competition rules become closer and closer. In the new world economic surroundings,the competition rules,which aim at regulating the domestic market,can’t fit in with the needs of the realities. The conflicts on the legislation,executing of the competition rules will be more and more,hi order to avoid or eliminate the law conflicts,the international society has been trying to coordinate the competition rules with all kinds of ways. Comparatively,the bilateral and regional treaties are mostly special treaties which rarely associate with trade rules,while multilateral conventions are usually mixed with trade rules. In this article,on the basis of analyzing the characters,contents and other aspects of trade rules and competition rules;comparing the three coordination patterns,the author draws the conclusion:In order to meet the new needs of world economy,the coordination of competition rules must associate with trade rules. We should play the complementary advantages between the trade rules and competition rules,cut off or avoid the conflicts between them. Therefore,the coordination of competition rules should commit in the multilateral trade system.
