【摘要】 本论文旨在对“契约型投资信托”这一事实现象进行法律研究。 第一部分，主要阐述契约型投资信托的法律含义及特征。 第二部分主要探讨投资信托各当事人在信托关系中的“角色定位”，即各当事人的法律地位。本部分概述并评价了有关契约型投资信托的组织结构之学说以及各国和地区的法定结构模式，提出了笔者所持的“共同受托人模式”的投资信托组织结构设计。 第三部分分析了契约型投资信托的法律依据，即投资信托法和信托契约基金、投资信托当事人及相互间的关系，并阐述了契约型投资信托这一活动设计之运作过程。 第四部分主要检讨了我国大陆契约型投资信托在立法和运作方面的现状，并提出了关于我国大陆契约型投资信托的立法构想。更多还原

【Abstract】 This dissertation aims to study in view of Legal point on contractual type investment trust. For this purpose , in Part One, various theories of investment trust are analysized, a definition of investment trust is concluded from the basis, in Part Two, a structural design of investment organization, model of joint trustee, is advanced. The study of legal bases of investment trust, that is the issues of investment trust law and trust indentures, investment trust fund, the relationships among parties in investment trust, and so on, is mainly made in Part Five. Criticisms of present situations of contractual type investment trust investment trust and suggestions of relative legislation in our country is the main contents in Part Four.更多还原
