【摘要】 法治现代化是指传统法制向现代法治转型的一个动态过程。它包括人类法律观念、行为的现代化、法律制度的现代化和法律实践的现代化。要实现法治现代化，探讨人的思想观念应具备或认可何种价值及法律制度本身应蕴含哪些价值就变得尤为重要。 工具理性与价值理性之间的关联性告诉我们，在中国法治现代化过程中，忽略价值观念对制度的影响和否认制度对价值观念的创新意义都是不可取的；在法治现代化进程中，只有解决好权力主体的矛盾，才能真正理解个人自由和政府权力之间的辩证统一关系，才能最大限度地为个人提供自由生活的空间；而对公共领域和私人领域的认识与界定是实现法治现代化的有效手段。 法治现代化的价值目标是表征于法律价值意义上的基本准则或法律的价值取向，亦即法治现代化的实质合理性。法律除必须具备形式合理性外，自由、平等、正义等基本的价值准则制约着法治的精神取向，引导着法治现代化的历史方向，在此基础上形成的包括上述价值目标的法律体系是中国法治现代化所指向的目标。更多还原

【Abstract】 The legal modernization is a dynamic process of change from tradition legal system to modern legal system. It includes the modernization of human’s law concept and behavior, law system and law practice. To achieve the goal of modernization, it is very important to probe into what values the human’s idea notion should possess and what values the law system itself should contain.The connection between the tool reason and value reason informs us that in the process of China’s legal modernization, it is not advisable to neglect the influence of the value concept on the system and deny the creative significance of the system values concept; In the process of legal modernization only after solving the contradiction of the body power, the dialectical unity relation of the personal freedom and government power can be correctly understood. And so then, we can provide space of free life for individual person to the full. And, to maintain and stipulate the common field and personal field is the effective way to realize legal modernization.The value objective of legal modernization is the basic principles manifested in the value significance of law or the value orientation of law, and that is substantive legitimacy of legal modernization. In addition to the formal legitimacy that the law should possess, such basic value principles as freedom, equality, and justice and so on restrict the spiritual orientation of law, lead the history direction of legal modernization.
