普通本科法学教育培养目标研究

【摘要】 本文运用马克思主义的立场、观点和方法，以概念界定为逻辑起点，分析、评价历史上大陆、普通两大法系及中国普通本科法学教育培养目标的理论与实践的流变及其实现途径和方法。本着“古为今用，洋为中用”、立足现实、放眼未来的原则，以二十一世纪全球文化与中国文化发展趋势为背景，构建二十一世纪中国普通本科法学教育培养目标及其实施方法。全文分为三章：第一章从培养目标、法学教育、本科教育和普通教育四个维度厘定普通本科法学教育培养目标的概念及结构；第二章分析评价大陆、英美两大法系及中国普通本科法学教育培养目标实践、理论及成因，为构建新型的培养目标作实践上与理论上的铺垫；第三章是本文的重心所在，以高等教育教学理论、文科教育理论、法学教育理论为理论指导，分析未来政治、经济、文化发展趋势对普通本科法学教育的要求，从而提出构建以素质教育为核心的法律通才培养目标，并提出切实可行的培养途径和方法。更多还原

【Abstract】 Beginning with the defination of the concept, this paper wields Maxism to anal- yse and comment the objectives in the general higher legal education of the graduate course belonging to common law countries, civil law countries and China. The con- cept of the objectives is defined in Chapter One. The objectives of common law coun- tries, civil law countries and China are analysed and evaluated in Chapter Two in or- der to lay a foundation for building up a new one for China. A new objectives of quali- ty education for the 21st century of China is built up in Chapter Three on the basis of higher education theory, art eduation theory and legal education theory, especially the trends of the politics, economy and culture in the future in China.更多还原
