【摘要】 生态环境损害金钱赔偿可以分为生态环境恢复原状费用赔偿、生态环境价值赔偿以及生态环境惩罚性赔偿三类，并分别对应不同的管理模式。生态环境恢复原状费用赔偿属于行为责任，其核心在于生态环境是否得到直接修复，该类赔偿虽可由环保团体等非政府组织管理，但应确保原告与法院对资金使用情况进行监督。生态环境价值赔偿属于公共财产，必须由政府专款专用于修复生态环境，将该类赔偿判归非政府主体或是未用于修复生态环境的做法均失之偏颇。生态环境惩罚性赔偿属于公法罚金的一种，在确保符合《预算法》规定的情况下，可以根据需要采取统筹使用或者专款专用模式。政府性基金能够兼容不同金钱赔偿的特性要求，未来应当予以重点考虑。更多还原

【Abstract】 Monetary compensation for ecological and environmental damage can be divided into three types:compensation for restoration costs,compensation for ecological and environmental value,and punitive compensation for ecological and environmental damage.These three types correspond to different management models.Compensation for restoration costs pertains to a behavioral liability,focusing on whether the ecosystem has been directly restored.Although such compensation may be administered by non-governmental entities such as environmental NGOs,both plaintiffs and courts must retain oversight over the use of funds.Compensation for ecological and environmental value constitutes public property and must be exclusively appropriated by the government for ecological restoration purposes.Awarding such compensation to non-governmental entities or diverting it from ecological restoration would be improper.Punitive compensation for ecological and environmental damage is a form of public law penalty.Subject to compliance with the Budget Law,it may be managed either through pooled allocation or earmarked allocation,depending on needs.Government funds are capable of accommodating the distinct charactaristics of different types of monetary compensation and should be given greater consideration in the future.更多还原
