【摘要】 2022年亚太地区RCEP协定的生效，加速了我国中医药传统知识登记制度的建构进程。在登记制度的设计上，国外传统医药知识丰富的国家作出了不同的尝试，尤以印度、泰国和秘鲁为代表。登记制度是创建中医药数据库的前置条件，而国外代表性传统知识来源国的经验能够为我国的实践提供可资借鉴的要素。以此为起点，围绕《中医药传统知识保护条例(草案征求意见稿)》相关条款，尝试从客体界定、实体规则和程序规则三个层次，分析该制度建构的核心要求，旨在为构建符合我国国情的中医药传统知识登记制度提供思路借鉴。更多还原

【Abstract】 The into-force of the RCEP agreement for the Asia-Pacific region in 2022 has accelerated the process of constructing a registration system for traditional knowledge of Chinese medicine in China. In the design of the registration system, different attempts have been made by foreign countries rich in traditional medical knowledge, especially represented by India, Thailand and Peru. The registration system is a prerequisite for the creation of a CM database, and the experiences of representative foreign TK source countries can provide elements to be learnt from for China’s practice. Taking this as a starting point, we try to analyze the core requirements for the construction of the system from the three levels of object definition, substantive rules and procedural rules, with a view to providing ideas for the construction of a registration system of traditional knowledge of Chinese medicine in line with China’s national conditions, focusing on the relevant provisions of the Regulations on the Protection of Traditional Knowledge of Chinese Medicine(Draft for comment)).更多还原
