【摘要】 在加快建设教育强国的背景下，探究教育法典中高等教育编的体系建构、结构安排与内容展开，是推进法典编纂工作的关键议题。在体系层面，延续《高等教育法》的基本框架，以“在完成高级中等教育基础上实施的教育”为调整范围，厘清高等教育编与职业教育编、终身教育编的内部边界，实现教育法与其他部门法的外部衔接。在结构设计上，构建以行政组织法为主线、兼容多元法律关系的七章架构，具体涵盖一般规定、高等教育发展规划与高等教育机构设立、高等学校的组织和活动、高等学校教师及其他教育工作者、高等学校的学生、高等教育学历和学位、高等教育的保障和监督等内容。在内容设置上，明确各章的基本规定与核心要点，通过整合高等教育领域的立法资源推动制度更新，形成切实可行的编纂方案。更多还原

【Abstract】 Against the backdrop of accelerating the development of China into an education power, exploring the system construction, structural design and detailed content formulation of the Higher Education Volume in the Education Code is a core topic for advancing the codification of the Education Code. At the system level, this volume upholds the basic framework of the Higher Education Law of the People’s Republic of China, accurately defines the statutory scope of regulation as “education imparted on the basis of completion of upper secondary education”, demarcates its internal boundaries from the Vocational Education Section and the Lifelong Education Section, and realizes external alignment with other branch laws. At the structural design level, this volume establishes a seven-chapter framework that takes administrative organization law as the main thread and accommodates diverse legal relations, which specifically covers: General Provisions, Higher Education Development Planning and the Establishment of Institutions of Higher Education, Organization and Activities of Institutions of Higher Education, Teachers and Other Educators of Higher Education Institutions, Students of Institutions of Higher Education, Academic Qualifications and Degrees in Higher Education, and Safeguard and Supervision of Higher Education. At the content formulation level, this volume clarifies the basic provisions and core elements of each chapter, promotes institutional upgrading by integrating legislative resources in the sphere of higher education, and forms a practicable codification scheme.更多还原
