【摘要】 为破解农业生态环境法治保障的现实困境，推动农业生态环境保护与农业可持续发展。采用文献研究和规范分析相结合的方法，系统梳理现行法律体系与实践运行中的突出问题。发现农业生态环境保护面临立法体系不完善、执法机制不顺畅、司法救济效能有限及公众参与薄弱等多重约束，因此，需要从构建现代化的生态环境法律规范体系、健全执法机制、优化司法保护模式、深化宣传教育，推动社会共治4个维度探索解决问题的对策。构建涵盖立法、执法、司法、社会共治的完备法治保障体系，才能为农业高质量发展与生态安全提供坚实法治支撑。更多还原

【Abstract】 To address the practical dilemmas in the legal protection of the agricultural ecological environment and promote the coordination between agricultural ecological environment protection and agricultural sustainable development. Adopting a combination of literature research and normative analysis,this study systematically sorts out the prominent problems in the operation of the current legal system and its practical implementation. It is found that agricultural ecological environment protection faces multiple constraints,including the incomplete legislative system,inefficient law enforcement mechanisms,limited effectiveness of judicial remedies,and weak public participation. To address this issue,it is necessary to explore countermeasures from four dimensions: constructing a modernized legal norm system for the ecological environment,improving law enforcement mechanisms,optimizing judicial protection models,and deepening publicity and education to promote social co-governance. Only by establishing a comprehensive legal safeguard system covering legislation,law enforcement,judicial justice,and social co-governance can we provide solid legal support for the high-quality development of agriculture and ecological security.更多还原
