【摘要】 数字全球化正在加速到来，个人信息跨境流动成为海南自由贸易港建设的核心命题。作为《个人信息保护法》第38条确立的个人信息跨境流动三大机制之一，个人信息出境认证是以基于认证备案管理的可信流通为价值旨归，构建起兼顾安全与效率的柔性合规路径。但该机制在海南自由贸易港的实施过程中，面临规则兼容性不足、内生成长性不高及国际互认度偏低等挑战。海南自由贸易港个人信息出境认证制度需要结合海南自由贸易港的产业发展和个人信息跨境传输的实际需求进行优化，遵循安全可控、高效便利、国际衔接的原则，探索构建动态化、场景化的认证标准，健全集成化、智能化的协同治理机制，培育专业化、国际化的多元共治生态，加快形成具有海南特色、统筹安全与效率、彰显国际信任的个人信息出境认证制度，为我国深度参与全球数字治理提供先行经验和实践参考。更多还原

【Abstract】 The acceleration of digital globalization has rendered the cross-border flow of personal information a core proposition in the construction of the Hainan Free Trade Port( HFTP). As one of the three mechanisms established under Article 38 of the Personal Information Protection Law,the Personal Information Cross-Border Transfer Certification aims to facilitate trustworthy circulation through certification and filing management. This mechanism constructs a flexible compliance pathway designed to balance security with efficiency. However,the implementation of this mechanism within the HFTP faces significant challenges,including insufficient rule compatibility,low endogenous growth capacity,and limited international mutual recognition. Consequently,the HFTP certification system requires optimization tailored to the region’s industrial development and practical data transmission needs. Reform efforts should adhere to the principles of security controllability,efficiency and convenience,and international alignment. Specifically,Hainan should explore the construction of dynamic,scenario-based certification standards and improve integrated,intelligent collaborative governance mechanisms. Furthermore,it is essential to cultivate a professional,internationalized ecosystem of multi-stakeholder governance.By doing so,Hainan can expedite the formation of a distinctive certification system that balances security with efficiency and demonstrates international trust,thereby providing pioneering experience and practical reference for China’s in-depth participation in global digital governance.更多还原
