【摘要】 涉企业数据案件逐年在增加，让现行法律面临数据权利保障的压力。反不正当竞争法保护路径、物权保护路径和著作权保护路径都存在局限性。新质生产力理念与企业数据发展目标具有相通之处，从新质生产力视域下探讨企业数据保护路径具有重要价值。现实依据方面，企业数据契合知识产权客体的特征，创设企业数据知识产权制度既能与现有法律衔接，又顺应新质生产力需要；基础理论方面，企业数据知识产权与洛克财产理论、知识产权功利论和信息产权理论的核心理念一致，因而创设企业数据知识产权具有学理正当性。制度回应方面，需要明确企业数据知识产权的适用范围、权利内容、登记效力以及配套机制，以期实现企业数据价值的充分释放。更多还原

【Abstract】 Cases involving enterprise data have been increasing year by year,which puts the current law under the pressure of data rights protection. The protection path of anti-unfair competition law,the protection path of property right and the protection path of copyright all have their own limitations. The concept of new quality productivity and the development goal of enterprise data are similar,and it is valuable to discuss the protection path of enterprise data from the perspective of new quality productivity. In terms of practical basis, enterprise data fits the characteristics of intellectual property object, and the creation of enterprise data intellectual property system can not only connect with the existing law,but also meet the needs of the new quality productivity;in terms of basic theory, enterprise data intellectual property rights and Lockean property theory, intellectual property utilitarianism and information property theory of the core concept is consistent, and thus the creation of a special enterprise data intellectual property rights system has legitimacy. The establishment of the system requires clear definitions of its scope of application, the content of rights,the legal effect of registration,and supporting mechanisms,with the aim of fully unlocking the value of corporate data.更多还原
