【摘要】 当前中国自贸试验区复制推广机制的运行状况,可以从主体和范围、载体和程度、行为逻辑、改革事项和实施路径等五个方面加以类型化分析。由于中央部署和地方落实、标准化推进和差异化发展、行政主导和市场驱动、谋求发展和防范风险、深化改革和坚持法治等五重张力的存在,该项复制推广机制的高效运转受到一定制约。为完善自贸试验区复制推广机制,应当健全央地协同和权责清晰的总体框架,兼顾一体改革和错位发展的布局规划,构建市场参与和政企互动的双向反馈渠道,统筹全流程管理和合理容错的风险防控体系,并且强化立法保障和备案审查的法治引领。此外,自贸试验区复制推广机制应当注重与优化营商环境、跨境电子商务、服务业扩大开放等其他领域复制推广机制的高效联动和梯度设计,强化各类改革事项的系统集成和协同耦合。更多还原

【Abstract】 The current operational status of the replication and promotion mechanism of China’s pilot free trade zones can be analyzed typologically from five dimensions: subjects and scope, vehicles and extent, underlying motivations, reform initiatives, and implementation paths. The efficient functioning of this mechanism faces constraints from five tensions: the central government’s deployment versus local governments’ implementation, standardized advancement versus diversified development, administrative dominance versus market drive, pursuing development versus preventing risks, and deepening reform versus upholding the rule of law. To enhance the replication and promotion mechanism of China’s pilot free trade zones, efforts should be made to improve the overall framework featuring central-local coordination and clearly defined rights and responsibilities, carry out the layout plan of ensuring integrated reform and differentiated development, build two-way feedback channels for market participation and governmententerprise interaction, integrate the risk prevention system concerning full-process management and reasonable tolerance for errors, and strengthen the guiding role of the rule of law through legislative guarantee and recording-and-review mechanism. Furthermore, the replication and promotion mechanism of China’s pilot free trade zones should emphasize efficient linkage and tiered design with the similar mechanism in other areas, such as optimization of the business environment, cross-border e-commerce, and expansion of the opening-up of the service sector, while enhancing the systemic integration and synergistic coupling of various reform initiatives.更多还原
