【摘要】 责令限期拆除是土地管理领域的重要执法手段。我国《土地管理法》中有4条关于责令限期拆除的规定。当前责令限期拆除处罚适用过程中主要存在处罚主体易混淆、处罚执行期限不明确、处罚程序规定不具体等困境。对此，应通过法律解释明确处罚主体，细化责令限期拆除的具体执行期限，完善责令限期拆除的处罚程序，最终实现土地执法效能与相对人权益保障的平衡，为推进土地治理法治化提供理论支撑。更多还原

【Abstract】 Ordering demolition within a time limit is an important law enforcement measure in the field of land administration. There are four provisions on ordering demolition within a time limit in China’s Land Administration Law. At present, the application of this penalty is confronted with major difficulties such as easy confusion of the subject of penalty, unclear time limit for penalty enforcement and unspecific provisions on penalty procedures. In this regard, it is necessary to clarify the subject of penalty through legal interpretation, specify the specific enforcement time limit for ordering demolition within a time limit, and improve the penalty procedures for ordering demolition within a time limit. Ultimately, the balance between the efficiency of land law enforcement and the protection of the rights and interests of the counterparties shall be achieved, so as to provide theoretical support for advancing the rule of law in land governance.更多还原
