【摘要】 非婚同居逐渐成为社会中较为常见的亲密关系模式。法律选取事实同居关系中的部分同居关系进行评价，是一种价值选择；其正当性基础在于法律规制的平等和法价值的实现，但仍应以婚姻关系为参照把握适当界限，并在两性关系、财产关系、亲子关系上呈现出强弱差异。《婚姻家庭编解释（二）》第四条构建了非婚同居析产规则回应实践需求，在处理非婚同居析产纠纷时，应秉持有别于夫妻财产制与财产法、尊重意思自由和家庭受国家保护的价值原则。在对规则的适用上，需合理界分同居关系析产纠纷、离婚析产纠纷与婚约财产纠纷，准确认定“非婚同居”“同居期间”以及规则内部的适用逻辑，并从体系解释角度理解非婚同居债务的认定与处理。此外，裁判者仍可基于当事人的诉讼请求，在非婚同居析产纠纷中参照适用婚姻家庭中的家务劳动补偿规则。更多还原

【Abstract】 Non-marital cohabitation has gradually become a more common form of intimate relationship in society. It is a value choice for the law to select some of the de facto cohabitation relationships for evaluation; its legitimacy is based on the equality of legal regulation and the realization of legal values, but the appropriate boundaries should still be grasped with reference to the marital relationship, and demonstrate varying degrees of significance in gender relations, property relations, and parent-child relations. Article 4 of the Interpretation(Ⅱ) of the Marriage and Family Part has constructed the property division rules in non-marital cohabitation in response to practical needs. In dealing with disputes over the division of property in non-marital cohabitation, the value principles should differ from those of the marital property system and property law, respecting the freedom of will and the protection of the family by the state. In the application of the rules, it is necessary to make a reasonable distinction between disputes over the division of property in cohabitation relationship, disputes over the division of property in divorce and disputes over betrothal property, accurately identify “non-marital cohabitation”, “cohabitation period” and the internal application logic of the rules, and to understand the determination and treatment of debts in non-marital cohabitation from the perspective of systematic interpretation. In addition, the adjudicators can still refer to the application of the rules on compensation for domestic labor in marriage and family based on the litigation request of the parties in disputes over the division of property in non-marital cohabitation.更多还原
