有声读物平台版权过滤义务的规范构造
Normative Construction of Copyright Filtering Obligations on Audiobook Platforms
【摘要】 当下,有声读物平台的著作权侵权行为呈现出规模化与隐蔽性特征。以“通知—删除”为核心的“避风港”规则在实践中被部分平台用作规避版权治理责任的工具,其技术中立预设也已动摇,出现制度失灵。欧盟确立的一般性过滤义务虽可强化平台责任,但同时伴随限制用户表达自由及运维成本过高等弊病。基于“通知—过滤”机制构建的过滤义务,更符合利益平衡与比例原则下的版权治理需求,并在法律制度与技术条件上具备实施基础,具有引入的正当性与可行性。有声读物平台版权过滤义务的规范构造,应以确立权利人通知触发机制和平台过滤响应义务的运行规则为前提,在此基础上明确义务实施的主体范围、错误过滤的救济程序,并为权利人与平台提供合作创收空间,实现版权过滤启动、运行、纠错和创收流程的良性循环。
【Abstract】 The copyright infringement activities on audiobook platforms exhibit characteristics of scalability and concealment. The "notice-and-takedown" mechanism, central to the "safe harbor" rule, has in practice been exploited by some platforms as a tool to evade copyright governance responsibilities. Its underlying assumption of technological neutrality has also been destabilized, leading to a breakdown of institutional effectiveness. Although the general filtering obligation established by the European Union can strengthen platform accountability, it simultaneously entails drawbacks such as constraints on users’ freedom of expression and excessive operational costs. A filtering obligation constructed on a "notice-and-filter" mechanism better aligns with the principles of proportionality and balanced interests in copyright governance and is supported by both legal frameworks and technical feasibility, demonstrating its legitimacy and practicability. The normative design of copyright filtering obligations for audiobook platforms should be grounded in the establishment of a rights holder–triggered notice mechanism and a platform–responsible filtering response system. On this basis, the scope of obligated actors, remedies for erroneous filtering and mechanisms for collaborative revenue generation between rights holders and platforms should be clearly delineated. Thereby, a virtuous cycle encompassing the initiation, operation, correction and monetization processes of copyright filtering will be created.
