【摘要】 在“技法互动”视角下，技术创新的范式变迁是反垄断法及其豁免制度变革的关键动因。在传统范式阶段，静态均衡的反垄断理论框架难以将技术创新纳入分析范畴，技术创新作为豁免事由长期被遮蔽而成为睡眠条款。在数字时代，技术创新的系统性、开放性和网络化特征改变了竞争形态，激活了豁免制度需求。应该推动反垄断理论向动态演化跃迁，凸显技术创新的内在价值属性及核心地位，充分考量创新的过程性及整体效果，激发数字平台的创新功能。在解释论层面，应该基于“动态效率+公共利益”的双重进路，明确技术创新豁免的适用条件及边界，完善豁免指南等配套机制，防范“错放”和“规制俘获”风险，最终实现创新与规范的动态平衡。更多还原

【Abstract】 Viewed through the lens of “technology-law interaction”, the paradigm transformation of technological innovation has emerged as a decisive force shaping the evolution of antitrust law and its exemption framework. Under the traditional paradigm, an antitrust theory premised upon static equilibrium was ill-equipped to integrate innovation into its analytical framework, leaving the innovation exemption dormant as a sleeping clause. In the digital era, however, the systemic, open, and networked nature of technological innovation has fundamentally reconfigured the competitive landscape, reigniting the need for a coherent exemption mechanism. To respond to this transformation, antitrust theory must advance toward a model of dynamic evolution—one that recognizes the intrinsic value and centrality of innovation, appreciates its processual and aggregate effects, and fully unleashes the innovative potential of digital platforms. From an interpretative standpoint, a dual analytical path grounded in dynamic efficiency and public interest should be adopted to clarify the substantive conditions and boundaries for applying the technological innovation exemption, refine complementary instruments such as exemption guidelines, and prevent the risks of misclassification and regulatory capture. Ultimately, the aim is to achieve a dynamic equilibrium between innovation and regulation, ensuring that legal norms evolve in concert with technological progress.更多还原
