【摘要】 确保国家粮食安全是乡村全面振兴的底线任务,加强对植物新品种权的保护尤为重要。现行法律已经构建了植物新品种权保护的基本框架,然而在实践中,植物新品种侵权行为隐蔽而复杂,法院在司法裁判中往往面临困境,主要表现在侵权行为认定、侵权损害赔偿以及证据规则等方面。针对上述问题,首先,应明确侵权行为的认定标准,确立商业目的要件的类型化适用标准,设立统一的品种鉴定标准并限定农民自繁自用的范围。其次,规范侵权损害赔偿司法适用标准,细化惩罚性赔偿适用规则。最后,优化侵权诉讼中的证据适用规则,完善证据保全制度,合理运用举证责任转移和举证妨碍制度。更多还原

【Abstract】 Ensuring national food security is the bottom-line task for the comprehensive revitalization of rural areas.Strengthening the protection of rights for new plant varieties is particularly important.The current laws have established the basic framework for the protection of plant variety rights.However, in practice,infringement of plant varieties is covert and complex,and courts often encounter difficulties in judicial adjudication,mainly manifested in the determination of infringement acts,infringement damages compensation,and evidence rules.To address the above issues,first of all,the criteria for identifying infringement should be clearly defined,the standardized application standards for the element of commercial purpose should be established,a unified variety identification standard should be set,and the scope of farmers’ self-breeding and self-use should be limited.Secondly,the judicial application standards for infringement damages compensation should be standardized,and the application rules for punitive damages should be refined.Finally,the application rules for evidence in infringement litigation should be optimized,the evidence preservation system should be improved,and the transfer of burden of proof and the system of obstruction of proof should be reasonably utilized.更多还原
