【摘要】 标准必要专利取得的地域性和实施的全球性导致其纠纷解决中的司法竞争不可避免。专利制度是国家经济安全和科技安全的重要保障。专利授权和实施的国家性是专利国际条约的基石。构建标准必要专利的全球性实体规则和国际性的争端解决机构不仅会侵蚀各国的立法和司法主权，而且会带来巨大的制度变迁成本，进而消灭专利制度的多样性和创新，因此既不现实也无必要。推动标准必要专利纠纷的友好解决，提升中国企业在世界标准制定和形成中的参与度和话语权，更符合中国利益。其路径和模式是，参照世界贸易组织发布的欧盟与中国的标准必要专利禁诉令争端的仲裁裁决，在司法竞争中秉持国际礼让，以促进标准必要专利许可的善意谈判为宗旨制定明确的禁诉令规则，由专利行政部门提供更多的标准必要专利公共服务。更多还原

【Abstract】 The territorial grant and the global implementation of standard essential patent(SEP) inevitably lead to judicial competition in its dispute resolution. The patent system serves as a critical safeguard for national economic and technological security. The territorial character of patent granting and implementation constitutes the cornerstone of international patent treaties. Establishing global substantive rules or international dispute resolution institutions for SEP would not only erode the legislative and judicial sovereignty of states, incurring substantial costs of institutional transformation, but also undermine the diversity and innovation of patent systems, thus being neither practical nor necessary. Promoting the amicable resolution of SEP disputes and strengthening the participation and voice of Chinese enterprises in global standards formulation and establishment is more aligned with China’s national interests. Drawing on the Award of Arbitrators published by the World Trade Organization regarding the dispute over anti-suit injunction between the European Union and China, observing international comity in judicial competition, formulating definite rules on anti-suit injunction and providing enhanced public services for SEP with the aim of fostering good-faith negotiations for SEP licensing would be better strategy.更多还原
