【摘要】 在新时代背景下，我国对历史文化保护传承给予了前所未有的高度重视，2021年9月《关于在城乡建设中加强历史文化保护传承的意见》为历史文化名城立法保护传承提供了新思路，并推动了《历史文化名城名镇名村保护条例》的修订与完善。为响应国家号召，各省市积极行动，纷纷制定出台地方性的保护条例，旨在加强对历史文化名城的保护与传承。在历史文化名城立法保护的过程中，如何实现正确的立法模式的选择并且合理优化立法路径成为重要的议题。从历史文化名城立法保护的现状出发，积极探索适合我国国情的立法模式，提出综合性立法模式的适当性建议，同时注重立法路径的优化，通过内部提升和外部协调两条路径，促进立法保护的科学性与合理性，旨在确保历史文化名城得到更为全面、深入的保护，促进历史文化名城保护传承的持续健康发展。更多还原

【Abstract】 In the context of the new era,China has attached unprecedented importance to the protection and inheritance of historical and cultural heritage.In September 2021,the "Opinions on Strengthening the Protection and Inheritance of Historical and Cultural Heritage in Urban and Rural Construction" provided new ideas for legislative protection and inheritance of historical and cultural cities,and promoted the revision and improvement of the "Regulations on the Protection of Historical and Cultural Cities,Towns,and Villages".In response to the national call,various provinces and cities have taken active actions and formulated local protection regulations,aiming to strengthen the protection and inheritance of historical and cultural cities.In the process of legislative protection of historical and cultural cities,how to choose the correct legislative model and optimize the legislative path reasonably has become an important issue.Starting from the current situation of legislative protection of historical and cultural cities,we actively explore legislative models that are suitable for China’s national conditions,propose appropriate suggestions for comprehensive legislative models,and focus on optimizing the legislative path.Through internal improvement and external coordination,we promote the scientific and rational nature of legislative protection,intending to ensure more comprehensive and in-depth protection of historical and cultural cities,and promote the sustainable and healthy development of the protection and inheritance of historical and cultural cities.更多还原
