【摘要】 宅基地使用权是我国特有的一种用益物权，一直承担着农村居民的基本社会福利和居住保障功能。但随着农村地区社会经济的发展，农民借款融资的需求日益突出，对宅基地使用权的财产功能的要求也愈发强烈。“三权分置”权利制度体系下的宅基地使用权，其内涵、权利属性、特点等都具有了新的含义，从而具备了可抵押性，这是宅基地权利体系“三权分置”法律制所蕴含的法律价值的体现。试点地区在开展“三权分置”模式下的宅基地使用权抵押探索中，还面临一些困惑性的问题，需要从制度设计上进一步的完善。更多还原

【Abstract】 The right to use homestead sites is a special kind of usufructuary right in China, which has always undertaken the basic social and housing security functions for rural residents. However, with the social and economic development in rural areas, farmers’ needs for borrowing and financing are increasingly prominent, and demand for the property function of the right to use homestead sites is also growing. The right to use homestead sites under the system of “three rights separation has new connotations, attributes, and characteristics, thus possessing the possibility of being mortgaged. This is a reflection of the legal value contained in the legal of “three rights separation” in the homestead rights system.
