宪法健康权条款之比较

【摘要】 健康权是得到国际法确认的一项权利,也是我国宪法间接表述并保护的一项基本权利;全世界193个国家的宪法中有136个以直接和间接的方式规定了健康权,120个国家将国家作为义务主体。健康权的核心内容是公民身体和精神有从国家获得免费的基本医疗和照顾的权利。各国宪法所规定的健康权的实现方式有6种,即法律保留,免费医疗,允许私立医疗机构、设施或医院的设立,发展传统医药,不得拒绝紧急医疗,建立健康保险制度;前2种是国家承担义务,后4种主要是社会承担义务。

【Abstract】 The right to health is a right recognized by international law and is also a fundamental right indirectly expressed and protected by the Constitution of China. Among the 193 countries in the world, 136 directly and indirectly stipulate the right to health, and 120 constitutions take the state as the subject of obligation. The core content of the right to health is that citizens have the right to receive free basic medical care and attention from the state both physically and mentally. There are six ways to realize the right to health as stipulated in the constitutions of various countries, namely, legal reservation, free medical care, allowing the establishment of private medical institutions, facilities or hospitals, developing traditional medicine, not refusing emergency medical care, and establishing a health insurance system. The first two types are obligations assumed by the state, while the latter four are mainly obligations assumed by society.
