【摘要】 在党内法规体系中,虽然准则一般以段落形式而非条款形式表达,但其仍具有规范形态。准则的规范主体从调控的全面程度和范围广度上都大于普通党内法规,体现了调控规范主体的层次性和重点性。准则的规范模式与法律规范类似,都存在义务性规范、禁止性规范和授权性规范三种模式。准则的规范性质具有政治和法治相结合、原则和规则相结合、指引和自律相结合、思想和行为相结合等特点。准则的规范功能主要表现为方向与大局的规范指引、融贯与补缺的规范作用、问题与应对的规范表达等方面。准则规范具有很强的思想性、政治性、综合性,其不断与时代俱进,强化着中国共产党依照党内法规管党治党的规范治理效能。更多还原

【Abstract】 Among the internal regulations of the Communist Party of China(CPC), codes of conducts generally appear in paragraphs, instead of sections and articles like regular legislation, yet they are nonetheless normative in form. For the codes of conducts, their normative subjects are greater than those of ordinary CPC regulations in terms of both the comprehensiveness and scope of regulation, demonstrating both hierarchy and priority in terms of the normative subjects. The codes are similar to laws and regulations in terms of normative modes, i. e., obligatory, prohibitive, and authoritative norms. The normative nature of the codes is characterized by the integration of politics and the rule of law, integration of principles and rules, integration of guidance and self-discipline, and integration of thought and behavior. The normative functions of the codes of conduct are mainly manifested in such aspects as normative guidance for direction and the overall situation, the normative role of integration and supplementation, and the standardized expression of problems and responses. The codes of conduct are highly ideological, political and comprehensive in nature, which move on with the times, and contribute to the effectiveness of the governance of the Communist Party of China in accordance with the Party’s rules and regulations.更多还原
