【摘要】 在老龄化进程不断加快的背景之下，由于体质随年龄增长的脆弱性与多变性，如何在老年人意思能力不断下降的前提下保护其医疗决定权已成为一项重要社会议题。在借鉴日本学者田山辉明提出医疗代诺权的基础上，系统梳理了医疗代诺权在中国的适用前景及行使要素，论证了对其研究的必要性与可行性，并提出应通过科学评估老年人的意思能力、规范医疗决策代理人的资格认定、明晰医疗决策代理人的权利内容、明确医疗代诺的起始时间和加强对医疗代诺行为的多重监督措施以期为相关立法及实践提供帮助。更多还原

【Abstract】 Against the backdrop of accelerating population aging, constrained by age-related fragility and physiological variability, how to protect the elderly’s medical decision-making rights under the premise of their continuously declining decision-making capacity has become an important social issue. Based on drawing on the proxy medical consent rights proposed by Japanese scholar Teruaki Tayama, this paper systematically sorted out the applicable prospects and exercise elements of proxy medical consent rights in China, as well as demonstrated the necessity and feasibility of researching it. It also proposed suggestions through scientifically assessing the decision-making capacity of the elderly, regulating the qualification recognition of medical decision-making agents, clarifying the rights content of medical decision-making agents, specifying the starting time of proxy medical consent rights, and strengthening multiple supervision of proxy medical consent behaviors, with a view to providing guidance for relevant legislation and practice.更多还原
