【摘要】 劳动者个人信息保护兼具个人信息保护的一般性与劳动者保护的特殊性，传统知情同意规则面临僵化、虚置的现实困境。知情同意规则作为个人信息保护的风险防范机制发挥着不可替代的作用。在既有法律框架下通过规则解释和制度续造，明确知情的内容与标准，完善劳动者个人“敏感信息-一般信息-去标识化信息”的类型划分并施加不同强弱同意模式、建立以同意撤回权为核心的个人信息动态同意机制，从而构建更具劳动关系适应性的知情同意适用机制，可以纾解劳动关系下知情同意规则的适用困境。更多还原

【Abstract】 Since the protection of laborers′ personal information merges the generality of personal info protection and laborer-specific particularities, the traditional informed-consent rule suffers rigidity and ineffectiveness. Nevertheless, as a pivotal risk-mitigation mechanism for personal information protection, this rule is irreplaceable. Within the existing legal framework, we can clarify the content and criteria of informed-consent via rule interpretation and institutional reconstruction. We can refine the classification of laborers′ personal data into "sensitive-general-de-identified information", apply different-intensity consent models, and set up a dynamic consent mechanism centered on the right to withdraw consent. By employing these strategies, we can construct a more labor-relation-compliant informed-consent mechanism, thereby resolving the application conundrums of the rule within labor relations.更多还原
