【摘要】 “健全铸牢中华民族共同体意识制度机制”是习近平总书记提出的重大理论与实践命题，也是党的二十届三中全会对推进国家治理体系和治理能力现代化提出的新要求。铸牢中华民族共同体意识的制度建设，不仅是一项政治要求，更是法治逻辑框架下的制度任务。但是目前法学概念界定较模糊，理论解释体系尚不完备，制度分布较为分散，法律规范偏重宣示性，权利义务条款虚置，导致制度效能未能充分释放。基于从分散走向体系化的要求，厘清中华民族共同体意识的规范内涵与制度价值，明确其在国家治理体系中的功能定位至关重要。通过顶层设计推动系统整合，实现制度的整体性与协调性，强化权利义务条款的实质建构与规则可操作性，从而增强制度的刚性约束与实践效能，力求将其提升为国家治理体系的核心制度安排。更多还原

【Abstract】 Optimizing the institutional mechanism for forging a strong sense of community for the Chinese nation represents a significant theoretical and practical proposition advanced by General Secretary Xi Jinping. It is also a new requirement set forth by the Third Plenary Session of the 20th CPC Central Committee, aimed at advancing the modernization of China’s governance system and capacity. Institution construction of forging a strong sense of community for the Chinese nation is not only a political imperative but, more fundamentally, an institutional task within the framework of rule-of-law. Currently, however, institutional effectiveness is hampered by a lack of definition clarity of legal concepts and an underdeveloped theoretical framework. This is compounded by fragmented institutional arrangements and legal norms that are largely declarative rather than practical, with clauses on rights and obligations often rendered ineffective. The demand for systemic integration makes it crucial to clarify the connotation and institutional value of the sense of community for the Chinese nation and to define its functional role within the national governance system. Through top-level design to drive systemic integration, we can achieve the coherence and coordination of institutions, strengthen the practicality of rights and obligations clauses and the feasibility of rules, thereby enhancing the binding force and practical efficacy of the institution, with the aim of elevating it into a core institutional arrangement within the national governance system.更多还原
