【摘要】 碳市场和电力市场的协同发展是在“双碳”目标下推进能源转型的关键，而法治协同是其重要保障，加强碳市场和电力市场的法治协同建设，可以更好地通过市场机制引导企业降碳减排，加快实现“双碳”目标。碳市场和电力市场的法治协同涉及的法律关系繁杂，从“政府与政府”“政府与市场”“碳市场与电力市场”三组核心关系的梳理切入，厘清纵横两个维度的权力配置逻辑、市场化与反市场化的制度逻辑以及碳市场和电力市场的协同基础，可以为碳市场和电力市场的法治协同提供理论支撑。在此基础上检视碳市场和电力市场的法治协同存在的权力配置不清、市场化制度不完善及碳减排效益重复计算三方面问题，进而分析相应对策：我国应在纵横两个维度的权力配置层面衡平中央集权与地方分权、构建多部门协同监管机制；在市场化制度保障层面完善碳-电价格传导制度、完善市场主体权利救济制度；在构建碳-电市场协同制度层面健全碳排放核算制度、厘清CCER和绿证的制度边界。更多还原

【Abstract】 The coordinated development of the carbon market and the electricity market is the key to promoting energy transformation under the "dual carbon" goals,and the rule-of-law coordination is an important guarantee.Strengthening the rule-of-law coordination between the carbon market and the electricity market can better guide enterprises to reduce carbon emissions through market mechanisms and accelerate the achievement of the "dual carbon" goals.The rule-of-law coordination between the carbon market and the electricity market involves complex legal relationships.By analyzing the three core relationships of "government and government", "government and market" and "carbon market and electricity market",the logic of power allocation in both vertical and horizontal dimensions,the institutional logic of marketization and anti-marketization,as well as the collaborative foundation of the carbon market and the electricity market are clarified,providing theoretical support for the rule-of-law coordination between the carbon market and the electricity market.On this basis,the problems in the rule-of-law coordination between the carbon market and the electricity market including unclear power allocation,imperfect market-oriented system and repeated calculation of carbon reduction benefits are examined.Then,the corresponding countermeasures are analyzed.China should balance centralization and decentralization at the level of power allocation in both vertical and horizontal dimensions and establish a multi-departmental collaborative supervision mechanism,improve the carbon-electricity price transmission system and the rights relief system for market entities at the level of market-based institutional guarantees,and improve the carbon emission accounting system at the level of establishing a coordinated carbonelectricity market system and clarify the institutional boundaries between CCER and green certificates.更多还原
