【摘要】 生态环境损害赔偿制度研究针对的损害对象是生态环境公益，是从保护角度为生态环境发声，为绿水青山代言，与其他以人类利用生态系统功能为目的的生态学研究有所不同。本文从生态学、生态系统、生态系统功能等概念内涵入手，厘清生态环境损害本质，探究生态环境损害鉴定评估核心目的与学理基础；从鉴定评估者视角分析鉴定目标中环境要素和植物、动物、微生物等生物要素的不利改变，以及生态系统功能退化等关键问题。梳理生态环境损害鉴定评估关键环节，以期明确“以生态科学捍卫生态环境损害鉴定评估公正性”。更多还原

【Abstract】 The study of the compensation system for ecological and environmental damage focuses on the public interest of the ecological environment. It advocates for the protection of ecological environments and speaks for the preservation of natural resources. This is distinct from other ecological studies that focus on the human use of ecosystem functions. This paper starts by examining concepts such as ecology, ecosystems, and ecosystem functions to clarify the essence of ecological and environmental damage. It explores the core purposes and theoretical foundations of ecological and environmental damage assessment and identification. From the perspective of assessors, the paper analyzes adverse changes in environmental elements, biological elements such as plants, animals, microorganisms, and critical issues such as ecosystem function degradation within the assessment targets. It outlines key aspects of ecological and environmental damage assessment to elucidate the fairness in assessing ecological and environmental damage through the defense of ecological science.更多还原
