【摘要】 自《中华人民共和国长江保护法》实施以来，国家持续强化长江流域司法保障建设，推行了一系列常态化举措，长江流域生态保护进入依法治江、依法护江的新阶段。为充分发挥司法在长江流域环境治理体系与治理能力现代化中的关键作用，从流域司法保护理念、司法协作机制和司法审判实务3个方面梳理了长江流域司法保护常态化措施面临的问题，并提出了相应对策：应牢固树立系统观念和绿色发展理念，通过制定跨流域司法协作制度，建立跨行政区划的协同发展机制；打造司法信息共享平台，构建司法系统内部协同沟通机制，打通司法保护内外反馈通道；充分落实长江流域生态环境案例释法工作，提升司法审判工作效能，促进长江大保护司法合力形成。更多还原

【Abstract】 Since the implementation of the Law of the People’s Republic of China on the Protection of the Yangtze River, China has continuously strengthened the construction of judicial protection in the Yangtze River Basin and implemented a series of routine measures. As a result, the ecological protection in the Yangtze River Basin has entered a new stage of governing and protecting the river in accordance with the law. To promote justice to play a key role in modernizing the environmental governance system and governance capacity of the Yangtze River Basin, it is particularly important to explore the problems in the routine judicial protection measures of the ecological environment in the Yangtze River Basin from the perspectives of the concept of judicial protection in the basin, the judicial collaboration mechanism, and the judicial trial practice. Corresponding countermeasures are proposed as follows. First, ecological protection in the basin must be based on the concept of systematic and green development, and a collaborative development mechanism across administrative divisions should be established through the development of a cross-basin judicial collaboration system. Second, a collaborative communication mechanism within the judicial system should be built through the creation of a judicial information-sharing platform, thus opening internal and external feedback channels of judicial protection. Third, we should fully implement the interpretation of ecological and environmental cases in the Yangtze River basin, enhance the effectiveness of judicial trials on ecological and environmental issues, and promote the formation of judicial synergy for the protection of the Yangtze River.更多还原
