【摘要】 随着人工智能技术的快速发展，监控视频智能化在司法领域的应用日益广泛，为案件侦破与事实认定提供了重要技术支撑。然而，司法实践中其应用仍面临诸多困境，包括算法黑箱与可解释性缺失、数据偏见与歧视风险、程序正当性存疑、隐私权保障不足以及证据审查规则不完善等。针对上述问题，有必要构建算法透明度机制，健全程序保障制度，完善证据审查规则，加强隐私权保护，并建立相应的技术监管体系。通过协同推进技术规范、法律健全与制度建设，在保障技术进步与维护司法公正之间实现动态平衡。更多还原

【Abstract】 With the rapid development of artificial intelligence technology, the intelligent application of surveillance video in the judicial field has become increasingly widespread, providing crucial technical support for case investigation and fact determination. However, the intelligent use of surveillance video in judicial practice faces challenges, including algorithmic black boxes and a lack of explainability, risks of data bias and discrimination, doubts about procedural legitimacy, insufficient protection of privacy rights, and incomplete rules for evidence review. To address these issues, it is essential to construct mechanisms for algorithm transparency, improve procedural safeguards, refine evidence review rules, enhance privacy protection, and establish a technical supervision system. By advancing technical standards, legal frameworks, and institutional development in a coordinated manner, a dynamic balance can be achieved between technological progress and the maintenance of judicial fairness.更多还原
